            9             AN ACT concerning crimes and punishment; relating to aggravated bat-
10             tery against a law enforcement officer; amending K.S.A. 21-3415 and
11             repealing the existing section.

13       Be it enacted by the Legislature of the State of Kansas:
14           Section 1. K.S.A. 21-3415 is hereby amended to read as follows:
15       21-3415. (a) Aggravated battery against a law enforcement officer is: (1)
16       An aggravated battery, as defined in subsection (a)(1)(A) of K.S.A. 21-
17       3414 and amendments thereto, committed against a uniformed or prop-
18       erly identified state, county  , or city  , law enforcement officer, a state cor-
19       rectional officer or employee, a city or county correctional officer or
20       employee, a juvenile correctional facility officer or employee or a juvenile
21       detention facility officer or employee, while the officer is engaged in the
22       performance of the officer's duty; or
23           (2) an aggravated battery, as defined in subsection (a)(1)(B) or (C) of
24       K.S.A. 21-3414 and amendments thereto, committed against a uniformed
25       or properly identified state, county  , or city  , law enforcement officer, a
26       state correctional officer or employee, a city or county correctional officer
27       or employee, a juvenile correctional facility officer or employee or a ju-
28       venile detention facility officer or employee, while the officer is engaged
29       in the performance of the officer's duty.
30           (b) (1) Aggravated battery against a law enforcement officer as de-
31       scribed in subsection (a)(1) is a severity level 3, person felony.
32           (2) Aggravated battery against a law enforcement officer as described
33       in subsection (a)(2) is a severity level   6 5, person felony.
34           (3) A person convicted of aggravated battery against a law enforce-
35       ment officer shall be subject to the provisions of subsection (g) of K.S.A.
36       21-4704 and amendments thereto.
37           Sec. 2. K.S.A. 21-3415 is hereby repealed.
38           Sec. 3. This act shall take effect and be in force from and after its
39       publication in the statute book.
