11             aviation airports; amending K.S.A. 75-5152 and repealing the existing
12             section.

14       Be it enacted by the Legislature of the State of Kansas:
15           Section 1. K.S.A. 75-5152 is hereby amended to read as follows:
16       75-5152. (a) On or before October 1, 1998, and on or before each   De-
17       cember 1 October 1, thereafter, the secretary of revenue shall determine
18       and certify to the director of accounts and reports the amount of the total
19       revenues received by the secretary from the taxes imposed pursuant to
20       articles 36 and 37 of chapter 79 of the Kansas Statutes Annotated, and
21       amendments thereto and deposited in the state treasury and credited to
22       the state general fund during the preceding fiscal year, which are attrib-
23       utable to the retail sale of aviation fuel.
24           (b) Upon receipt of each certification under subsection (a), the direc-
25       tor of accounts and reports shall transfer from the state general fund to
26       the public use general aviation airport development fund established by
27       K.S.A. 75-5061, and amendments thereto, an amount equal to the amount
28       so certified on October 1, 1998, and on each October 1 thereafter.
29           Sec. 2. K.S.A. 75-5152 is hereby repealed.
30           Sec. 3. This act shall take effect and be in force from and after its
31       publication in the statute book.
