            9             AN ACT concerning civil procedure; relating to exemptions from legal
10             process; amending K.S.A. 60-2313 and K.S.A. 1997 Supp. 39-717 and
11             repealing the existing sections.

13       Be it enacted by the Legislature of the State of Kansas:
14           Section 1. K.S.A. 1997 Supp. 39-717 is hereby amended to read as
15       follows: 39-717. (a) Assistance granted under the provisions of this act
16       shall not:
17           (1) Be sold or otherwise disposed of to others by the client or by
18       anyone else except under the rules and regulations of the secretary of
19       social and rehabilitation services; or
20           (2) knowingly be purchased, acquired or possessed by anyone unless
21       the purchase, acquisition or possession is authorized by the rules and
22       regulations of the secretary of social and rehabilitation services or the
23       laws under which the assistance was granted.
24           (b) (1) Any person convicted of violating the provisions of this section
25       shall be guilty of a class A nonperson misdemeanor if the value of the
26       assistance sold or otherwise disposed of, purchased, acquired or possessed
27       was less than $500.
28           (2) Any person convicted of violating the provisions of this section
29       shall be guilty of a severity level 9, nonperson felony if the value of the
30       assistance sold or otherwise disposed of, purchased, acquired or possessed
31       was at least $500 but less than $25,000.
32           (3) Any person convicted of violating the provisions of this section
33       shall be guilty of a severity level 7, nonperson felony if the value of the
34       assistance sold or otherwise disposed of, purchased, acquired or possessed
35       was $25,000 or more.
36           (c) None of the money paid, payable, or to be paid, or any tangible
37       assistance received under this act shall be subject to execution, levy, at-
38       tachment, garnishment, or other legal process, or to the operation of any
39       bankruptcy or insolvency law.
40           Sec. 2. K.S.A. 60-2313 is hereby amended to read as follows: 60-
41       2313. (a) Except to the extent otherwise provided by law, every person
42       residing in this state shall have exempt from seizure and sale upon any
43       attachment, execution or other process issued from any court in this state:

  1           (1) Any pension, annuity, retirement, disability, death or other ben-
  2       efit exempt from process pursuant to K.S.A. 12-111a, 12-5005, 13-1246a,
  3       13-14,102, 13-14a10, 14-10a10, 20-2618, 72-1768, 72-5526, 74-4923,
  4       74-4978g, 74-49,105 or 74-49,106, and amendments thereto.
  5           (2) Any public assistance benefits exempt pursuant to K.S.A. 39-717
  6       and amendments thereto.
  7           (3) (2) Any workers' compensation exempt from process pursuant to
  8       K.S.A. 44-514 and amendments thereto.
  9           (4) (3) Any unemployment benefits exempt from process pursuant to
10       K.S.A. 44-718 and amendments thereto.
11           (5) (4) Any partnership property exempt from process pursuant to
12       K.S.A. 56-325 and amendments thereto.
13           (6) (5) Any crime victims compensation award exempt from process
14       pursuant to K.S.A. 74-7313 and amendments thereto.
15           (7) (6) Any liquor license, club license or cereal malt beverage whole-
16       saler's or distributor's license exempt from process pursuant to K.S.A. 41-
17       326, 41-2629 or 41-2714, and amendments thereto.
18           (8) (7) Any interest in any policy of insurance or beneficiary certifi-
19       cates upon a person's life exempt from process pursuant to K.S.A. 40-414
20       and amendments thereto.
21           (9) (8) Any fraternal benefit society benefit, charity, relief or aid ex-
22       empt from process pursuant to K.S.A. 40-711 and amendments thereto.
23           (10) (9) Any trust funds held in a cemetery merchandise trust and
24       exempt from process pursuant to K.S.A. 16-328 and amendments thereto.
25           (11) (10) Any funds held in an account or trust established pursuant
26       to a prearranged funeral agreement, plan or contract and exempt from
27       process pursuant to K.S.A. 16-310 and amendments thereto.
28           (b) This section shall be part of and supplemental to article 23 of
29       chapter 60 of the Kansas Statutes Annotated.
30           Sec. 3. K.S.A. 60-2313 and K.S.A. 1997 Supp. 39-717 are hereby
31       repealed.
32           Sec. 4. This act shall take effect and be in force from and after its
33       publication in the statute book.
