            9             AN ACT relating to elections; concerning eligibility for voting at primary
10             elections; amending K.S.A. 25-205, 25-210, 25-211, 25-212, 25-213a,
11             25-216 and 25-1310 and K.S.A. 1997 Supp. 25-213, 25-1122d and
12             25-3301 and repealing the existing sections.
13            
14       Be it enacted by the Legislature of the State of Kansas:
15           Section 1. K.S.A. 1997 Supp. 25-3301 is hereby amended to read as
16       follows: 25-3301. (a) Each registered voter of this state who has declared
17       a party affiliation as provided in this section or in K.S.A. 25-3304, and
18       amendments thereto, shall be entitled to vote at every partisan primary
19       election for one candidate for each office, except the offices of precinct
20       committeeman and committeewoman, regardless of such voter's political
21       affiliation or the political affiliation or political party of the candidate.
22       Only registered voters of this state who have declared a party affiliation
23       as provided in this section or in K.S.A. 25-3304, and amendments thereto,
24       shall be entitled to vote for candidates for the offices of precinct commit-
25       teeman and committeewoman for the party with which the voter is affil-
26       iated.
27           (b) The county election officer shall prepare for each voting place at
28       each partisan primary election a party affiliation list, duly certified by such
29       officer, which clearly indicates the party affiliation of each registered voter
30       in the voting area who has declared a party affiliation. The registration
31       book prepared for a voting place pursuant to K.S.A. 25-2318, and amend-
32       ments thereto, may be used as such list, but no registration book prepared
33       for use at a voting place in an election other than a partisan primary
34       election or an election held at the same time as a partisan primary election
35       shall indicate in any manner the party affiliation of any voter. Such list
36       shall be delivered by the supervising judge to the voting place before the
37       opening of the polls.
38           (c) The party affiliation list provided for by subsection (b) shall be
39       used to determine the party affiliation of a voter offering to vote for the
40       offices of precinct committeeman and committeewoman at a partisan pri-
41       mary election and of a voter applying for an advance voting ballot pursuant
42       to K.S.A. 25-1122, and amendments thereto for the purpose of voting at
43       such primary. If a voter's party affiliation is not indicated on the party

  1       affiliation list, such voter shall state the voter's party affiliation in writing
  2       on a form prescribed by the secretary of state. A judge at the precinct
  3       polling place, or the county election officer or such officer's designee,
  4       shall give such voter a primary ballot for the offices of precinct commit-
  5       teeman and committeewoman of the party of the voter's party affiliation,
  6       and such person thereupon shall be entitled to vote. Such a statement of
  7       party affiliation shall constitute a declaration of party affiliation, and all
  8       such signed statements shall be returned to the county election officer,
  9       who shall cause them to be recorded on the party affiliation list.
10           (d) No voter shall be allowed to receive the ballot for the offices of
11       precinct committeeman and committeewoman of any political party except
12       that with which such voter is affiliated.
13           (e) Party affiliation statements shall be preserved for five years. The
14       county election officer may dispose of the statements in the manner ap-
15       proved for destruction of ballots as provided in K.S.A. 25-2708, and
16       amendments thereto.
17           (f) The county election officer shall update party affiliation lists as
18       provided by rules and regulations of the secretary of state.
19           Sec. 2. K.S.A. 25-205 is hereby amended to read as follows: 25-205.
20       (a) Except as otherwise provided in subsection (h) Subject to the require-
21       ments of K.S.A. 25-202, and amendments thereto, the names of candidates
22       for national, state, county and township offices shall be printed upon the
23       official primary ballot when each shall have qualified to become a can-
24       didate by one of the following methods and none other: (1) They shall
25       have had filed in their behalf, not later than 12:00 noon, June 10, prior
26       to such primary election, or if such date falls on Saturday, Sunday or a
27       holiday, then before 12:00 noon of the next following day that is not a
28       Saturday, Sunday or a holiday, nomination petitions, as provided for in
29       this act; or (2) they shall have filed not later than the time for filing
30       nomination petitions, as above provided, with the proper officer a dec-
31       laration of intention to become a candidate, accompanied by the fee re-
32       quired by law. Such declaration shall be prescribed by the secretary of
33       state.
34           (b) Nomination petitions shall be in substantially the following form:
35           I, the undersigned, an elector of the county of ________, and state of Kansas, and
36       a duly registered voter, and a member of ______ party, hereby nominate
,
37       who resides in the township of ________ (or at number ________ on ________
38       street, city of ________), in the county of ________ and state of Kansas, as a
39       candidate for the office of (here specify the office) ________, to be voted for at the
40       primary election to be held on the first Tuesday in August in ________, as representing
41       the principles of such party; and I further declare that I intend to support the candidate
42       herein named and that I have not signed and will not sign any nomination petition for any
43       other person, for such office at such primary election.

  5           All nomination petitions shall have substantially the foregoing form,
  6       written or printed at the top thereof. No signature shall be counted unless
  7       it is upon a sheet having such written or printed form at the top thereof.
  8           (c) Each signer of a nomination petition shall sign but one such pe-
  9       tition for the same office, and shall declare that such person intends to
10       support the candidate therein named, and shall add to such person's sig-
11       nature and residence, if in a city, by street and number (if any); or, oth-
12       erwise by post-office address. No signature shall be counted unless the
13       place of residence of the signer is clearly indicated and the date of signing
14       given as herein required and if ditto marks are used to indicate address
15       they shall be continuous and clearly made. Such sheets shall not be cut
16       or pasted together.
17           (d) All signers of each separate nomination petition shall reside in the
18       same county and election district of the office sought. The affidavit de-
19       scribed in this paragraph of a qualified elector who resides in such county
20       and election district or of the candidate shall be appended to each petition
21       and shall contain, at the end of each set of documents carried by each
22       circulator, a verification, signed by the circulator or the candidate, to the
23       effect that such circulator or the candidate personally witnessed the sign-
24       ing of the petition by each person whose name appears thereon. The
25       person making such affidavit shall be duly registered to vote.
26           (e) Except as otherwise provided in subsection (g), Nomination pe-
27       titions shall be signed:
28           (1) If for a state officer elected on a statewide basis or for the office
29       of United States senator, by voters equal in number to not less than 1%
30       of the total of the current voter registration of the party designated in the
31       state as compiled by the office of the secretary of state;
32           (2) If for a state or national officer elected on less than a statewide
33       basis, by voters equal in number to not less than 2% of the total of the
34       current voter registration of the party designated in such district as com-
35       piled by the office of the secretary of state, except that for the office of
36       district magistrate judge, by not less than 2% of the total of the current
37       voter registration of the party designated in the county in which such
38       office is to be filled as certified to the secretary of state in accordance
39       with K.S.A. 25-3302, and amendments thereto;
40           (3) If for a county office, by voters equal in number to not less than
41       3% of the total of the current voter registration of the party designated
42       in such district or county as compiled by the county election officer and
43       certified to the secretary of state in accordance with K.S.A. 25-3302, and

  1       amendments thereto; and
  2           (4) If for a township office, by voters equal in number to not less than
  3       3% of the total of the current voter registration of the party designated
  4       in such township as compiled by the county election officer and certified
  5       to the secretary of state in accordance with K.S.A. 25-3302, and amend-
  6       ments thereto.
  7           (f) Subject to the requirements of K.S.A. 25-202, and amendments
  8       thereto, any political organization filing nomination petitions for a major-
  9       ity of the state or county offices, as provided in this act, shall have a
10       separate primary election ballot as a political party and, upon receipt of
11       such nomination petitions, the respective officers shall prepare a separate
12       state and county ballot for such new party in their respective counties or
13       districts thereof in the same manner as is provided for existing parties.
14           (g) (1) In the year 1992, if new boundary lines are defined and dis-
15       tricts established in the manner prescribed by law on or after the effective
16       date of this act and on or before May 10, 1992, for the offices of repre-
17       sentative in the United States congress, senator and representative in the
18       legislature of the state of Kansas, and member of the state board of ed-
19       ucation, nomination petitions for nomination to such offices shall be
20       signed by voters equal in number to not less than 1% of the total of the
21       current voter registration of the party designated in the district as com-
22       piled by the office of the secretary of state.
23           (2) In the year 1992, if new boundary lines are defined and districts
24       established in the manner prescribed by law on or after May 11, 1992,
25       nomination petitions for nomination to the following offices shall be
26       signed by registered voters of the party designated in the district equal
27       in number to not less than the following:
28           (A) For the office of representative
29           in the United States congress 1,000 registered voters;
30           (B) for the office of member of the
31           state board of education 300 registered voters;
32           (C) for the office of state
33           senator 75 registered voters; and
34           (D) for the office of state
35           representative 25 registered voters.
36           (h) (1) In the year 1992, if new boundary lines are defined and dis-
37       tricts established in the manner prescribed by law for the offices of rep-
38       resentative in the United States congress, senator and representative in
39       the legislature of the state of Kansas, and member of the state board of
40       education, on or before June 12, 1992, the deadline for filing nomination
41       petitions and declarations of intention to become a candidate for such
42       office, accompanied by the fee required by law, shall be June 24, 1992.
43           (2) In the year 1992, if new boundary lines are defined and districts

  1       established in the manner prescribed by law for the offices of represen-
  2       tative in the United States congress, senator and representative in the
  3       legislature of the state of Kansas, and member of the state board of ed-
  4       ucation, on or after June 13, 1992, the deadline for filing nomination
  5       petitions and declarations of intention to become a candidate for such
  6       office, accompanied by the fee required by law, shall be July 14, 1992.
  7           Sec. 3. K.S.A. 25-210 is hereby amended to read as follows: 25-210.
  8       The official primary election ballot for national and state offices and, the
  9       official primary election ballot for county and township offices and the
10       official election ballots for precinct committeeman and committeewoman
11       of each political party shall be arranged on the ballot, printed, voted, and
12       canvassed in the same manner as is now or hereafter provided by law for
13       the arrangement, printing, voting, and canvassing of official general bal-
14       lots for national and state offices and official general ballots for county
15       and township offices, except as otherwise provided by law.
16           Sec. 4. K.S.A. 25-211 is hereby amended to read as follows: 25-211.
17       The county election officer shall, at least two (2) weeks before the primary
18       election, mail to each person whose name is to appear on the official
19       ballot in such county, to the address given in such papers, a copy of the
20       first issue of the county paper containing the names and addresses of
21       those whose names will be printed on the national, state, county and
22       township primary election ballots. The chairman chairperson of each
23       party shall, on or before the eleventh day preceding such primary election,
24       suggest to the county election officer any changes that he such chairper-
25       son may consider should be made in the ballot applicable to his party,
26       and if upon examination the county election officer shall find any error
27       or omission in said the ballot, he such chairperson shall correct the ballot
28       and cause the same to be printed and distributed as required by law in
29       the case of ballots for the national, state, county and township general
30       election. The number of ballots of each party to be furnished to each
31       precinct shall be adequate in the opinion of the county election officer.
32           Sec. 5. K.S.A. 25-212 is hereby amended to read as follows: 25-212.
33       (a) Names of the candidates of each political party shall be arranged in a
34       separate column on the official primary election ballot.
35           (b) In case there are nomination petitions or declarations of intention
36       to become a candidate on file for more than one candidate or for more
37       than one pair of candidates for governor and lieutenant governor, of the
38       same party for any national or state office, the secretary of state shall
39       divide the state or appropriate part thereof, into as many divisions as there
40       are names to go on such party ballot for that office. Such divisions shall
41       be as nearly equal in number of members of such party as is convenient
42       without dividing any one county. In making such division the secretary of
43       state shall take the alphabetical list of counties in regular order until the

  1       secretary of state gets the required proportion of party members of such
  2       party based upon the party affiliation lists as shown by the certificates of
  3       the respective county election officers, and so on through the list of coun-
  4       ties until the secretary of state gets the proper proportion of party mem-
  5       bers in each division. The secretary of state shall also take the alphabetical
  6       list of candidates or pairs of candidates, of the same political party, in
  7       regular order and in certifying to the county election officer the list of
  8       names for whom nomination petitions or declarations of intent to become
  9       a candidate have been filed, shall place one name or pair of candidates
10       at the head of the list, for the political party, in the first division of coun-
11       ties, another in the second division, and so on with all the candidates for
12       any particular office, so that every candidate or pair of candidates for any
13       office shall be at the head of the list in one division of the state and second
14       in another division thereof, and so forth. When, in the case of candidates,
15       of the same political party, for the office of congressman, district judge,
16       district magistrate judge, state senator, state representative or state board
17       of education member, the secretary of state finds that the secretary of
18       state cannot get a fair proportion of party members to give each candidate
19       for congressman, district judge, district magistrate judge, state senator,
20       state representative or state board of education member in any given
21       district an equitable or fair opportunity to have the candidate's name first
22       on the ballot in the respective counties of the district, the secretary of
23       state shall order the county election officers in the various counties of the
24       district to rotate the names of the candidates for such district offices
25       according to precinct. If voting machines are used the arrangement of
26       names of candidates or pair of candidates for all offices on the voting
27       machines shall be rotated, as near as may be, according to precinct.
28           (c) The arrangement of the names certified by the secretary of state
29       shall govern the county election officer in arranging the primary election
30       ballot, and the county election officer in preparing the ballot for such
31       officer's county shall follow the same arrangement as provided in this
32       section for the secretary of state, for the candidates nominated for county
33       offices, using the township and precincts of the county in making the
34       division.
35           Sec. 6. K.S.A. 1997 Supp. 25-213 is hereby amended to read as fol-
36       lows: 25-213. (a) At all national and state primary elections, the national
37       and state offices as specified for each in this section shall be printed upon
38       the official primary election ballot for national and state offices and the
39       county and township offices as specified for each in this section shall be
40       printed upon the official primary election ballot for county and township
41       offices. The official primary election ballots shall have the following head-
42       ing:

  3              To vote for a person whose name is printed on the ballot make a cross or check
  4             mark in the square at the left of the person's name. To vote for a person whose name
  5             is not printed on the ballot, write the person's name in the blank space, if any is
  6             provided, and make a cross or check mark in the square to the left.
  7           The words national and state or the words county and township shall
  8       appear on the line preceding the part of the form shown above.
  9           The form shown shall be followed by the names of the persons for
10       whom nomination petitions or declarations have been filed according to
11       law for political parties having primary elections, and. Names of the can-
12       didates of each political party shall be arranged in a separate column
13       following a heading stating the name of the party. Names of candidates
14       for the national and state offices shall appear on the ballot in the following
15       order: United States senator, United States representative from

16       district, governor and lieutenant governor, secretary of state, attorney
17       general, state treasurer, commissioner of insurance, senator ____ dis-
18       trict, representative ____ district, district judge ____ district, district
19       magistrate judge ____ district, district attorney ____ judicial district,
20       and member state board of education ____ district. For county and
21       township offices the form shall be followed by the names of persons for
22       whom nomination petitions or declarations have been filed according to
23       law for political parties having primary elections. Names of candidates for
24       the county and township offices shall appear on the ballot in the following
25       order: commissioner ____ district, county clerk, treasurer, register of
26       deeds, county attorney, sheriff, surveyor, township trustee, township
27       treasurer, township clerk. When any office is not to be elected, it shall be
28       omitted from the ballot. Other offices to be elected but not listed, shall
29       be inserted in the proper places. For each office there shall be a statement
30       of the number to vote for.
31           To the left of each name there shall be printed a square. Official pri-
32       mary election ballots may be printed in one or more columns. The names
33       certified by the secretary of state or county election officer shall be
34       printed on official primary election ballots and no others. In case there
35       are no nomination petitions or declarations on file for any particular of-
36       fice, the title to the office shall be printed on the ballot followed by a
37       blank line with a square, and such title, followed by a blank line, may be
38       printed in the list of candidates published in the official paper. No blank
39       line shall be printed following any office where there are nomination
40       petitions or declarations on file for the office except following the offices
41       of precinct committeeman and precinct committeewoman. Except as oth-
42       erwise provided in this section, no person's name shall be printed more
43       than once on either the official primary election ballot for national and

  1       state offices or the official primary election ballot for county and township
  2       offices. No name that is printed on the official primary election ballot as
  3       a candidate of a political party shall be printed or written in as a candidate
  4       for any office on the official primary election ballot of any other political
  5       party. If a person is a candidate for the unexpired term for an office, the
  6       person's name may be printed on the same ballot as a candidate for the
  7       next regular term for such office. The name of any candidate on the ballot
  8       may be printed on the same ballot as such candidate and also as a can-
  9       didate for precinct committeeman or committeewoman. No name that is
10       printed on the official primary election ballot for national and state offices
11       shall be printed or written in elsewhere on such ballot or on the official
12       primary election ballot for county and township offices except for precinct
13       committeeman or committeewoman. No name that is printed on the of-
14       ficial primary election ballot for county and township offices shall be
15       printed or written in on the official primary election ballot for national
16       and state offices or elsewhere on such county and township ballot except
17       for precinct committeeman or committeewoman.
18           No person shall be elected to the office of precinct committeeman or
19       precinct committeewoman where no nomination petitions or declarations
20       have been filed, unless the person receives at least five write-in votes. As
21       a result of a primary election, no person shall receive the nomination and
22       no person's name shall be printed on the official general election ballot
23       when no nomination petitions or declarations were filed, unless the per-
24       son receives votes equal in number to not less than 10% of the electors
25       who voted for the office of secretary of state at the last preceding general
26       election for such office in the state, county or district in which the office
27       is sought, except that a candidate for township office may receive the
28       nomination and have such person's name printed on the ballot where no
29       nomination petitions or declarations have been filed if such candidate
30       receives three or more write-in votes. No such person shall be required
31       to obtain more than 5,000 votes.
32           (b) The official election ballots for precinct committeemen and com-
33       mitteewomen shall be in the following form:

  1       vided or otherwise provided by law the form of such ballots and the ar-
  2       rangement of names thereon shall be in the form and manner prescribed
  3       by the secretary of state.
  4           No person shall be elected to the office of precinct committeeman or
  5       precinct committeewoman where no nomination petitions or declarations
  6       have been filed, unless the person receives at least five write-in votes.
  7           Sec. 7. K.S.A. 25-213a is hereby amended to read as follows: 25-
  8       213a. Notwithstanding any provision of K.S.A. 25-213 and amendments
  9       thereto, ;(tri-stars)ere the following statement shall be printed upon the official
10       primary election ballots ;(tri-stars)e following heading (in lieu of the heading
11       otherwise provided by law) when the governor and lieutenant governor
12       are to be nominated:

16       the ballot make a cross or check mark in the square to the left of the names of the persons
17       running together for such offices.

19       on the ballot make a cross or check mark in the square to the left of the name of the person
20       for whom you desire to vote. To vote for a person whose name is not printed on the ballot,
21       write such person's name in the blank space provided for the purpose and make a cross or
22       check mark in the square to the left.''
23           After the names of each office, there shall be a statement of the number
24       of candidates to vote for, for the particular office, and for one pair of
25       governor and lieutenant governor candidates running together. When the
26       governor, lieutenant governor, secretary of state, attorney general, state
27       treasurer and commissioner of insurance are not to be nominated, no
28       reference to those offices shall appear on the ballot.
29           To the left of governor and lieutenant governor running together, one
30       square shall be printed to the left of the names of each pair running
31       together. No blank lines shall be printed following the offices of governor
32       and lieutenant governor.
33           Sec. 8. K.S.A. 25-216 is hereby amended to read as follows: 25-216.
34       The right of any person to vote at any national, state, county and township
35       primary election may be challenged by any elector upon the same ground
36       and his such person's right to vote be determined in the same manner as
37       at a national, state, county and township general election, except as oth-
38       erwise provided herein.
39           If the person offering his vote be challenged as unqualified on the
40       ground that he is not a member of the party announced by himself, he
41       shall make and subscribe an affidavit in the following form, which shall
42       be presented to and retained by the election board, and returned by the
43       supervising judge with the poll list:

13           Sec. 9. K.S.A. 1997 Supp. 25-1122d is hereby amended to read as
14       follows: 25-1122d. (a) The application for an advance voting ballot shall
15       be accompanied by an affirmation in substance as follows:

32           (b) An application for permanent advance voting status shall be on a
33       form prescribed by the secretary of state for this purpose. Such applica-
34       tion shall contain an affirmation concerning substantially the same infor-
35       mation required in subsection (a) and in addition thereto a statement
36       regarding the permanent character of such illness or disability.
37           (c) Any application by a former precinct resident shall state both the
38       former and present residence, address, precinct and county of such for-
39       mer precinct resident and the date of change of residence.
40           Sec. 10. K.S.A. 25-1310 is hereby amended to read as follows: 25-
41       1310. A kind or make of voting machine approved by the secretary of
42       state:
43           (1) Must be so constructed as to provide facilities for voting for the

  1       candidates for nomination or election of at least seven different political
  2       parties or organizations;
  3           (2) must permit a voter to vote for any person for any office although
  4       not nominated as a candidate by any political party or organization;
  5           (3) must provide for voting on constitutional amendments, proposi-
  6       tions or questions;
  7           (4) must be so constructed that as to primaries where candidates are
  8       nominated by political parties it can be so locked from the outside that
  9       the voter can vote only for the candidates of the political party with which
10       such voter is affiliated or, if not affiliated, according to such voter's dec-
11       laration when applying to vote;
12           (5) must be so constructed as to prevent voting for more than one
13       person for the same office except where the voter is lawfully entitled to
14       vote for more than one person for that office;
15           (6) (5) must afford the voter an opportunity to vote for any or all
16       persons for an office as such voter is by law entitled to vote for and no
17       more, and at the same time preventing such voter from voting for the
18       same person twice for the same office;
19           (7) (6) must be so constructed that in presidential elections the pres-
20       idential electors of any political party for presidential and vice-presidential
21       candidates may be voted upon at the same time;
22           (8) (7) must provide facilities for ``write-in'' votes;
23           (9) (8) must provide for voting in absolute secrecy in voting, except
24       as to persons entitled to assistance;
25           (10) (9) must be so constructed as to accurately account for every
26       vote cast upon it;
27           (11) (10) be provided with a ``protective counter'' or ``protective de-
28       vice'' whereby any operation of the machine before or after the election
29       will be detected;
30           (12) (11) be provided with a counter which will show at all times
31       during the election how many persons have voted; and
32           (13) (12) be provided with a mechanical model illustrating the man-
33       ner of voting on the machine, suitable for the instruction of voters.
34           Voting machines approved by the state executive council shall continue
35       on the approved list of voting machines.
36           Sec. 11. K.S.A. 25-205, 25-210, 25-211, 25-212, 25-213a, 25-216 and
37       25-1310 and K.S.A. 1997 Supp. 25-213, 25-1122d and 25-3301 are hereby
38       repealed.
39           Sec. 12. This act shall take effect and be in force from and after its
40       publication in the Kansas register.
