          12             AN ACT making and concerning appropriations for the fiscal years ending
13             June 30, 1998, and June 30, 1999, and authorizing certain financing,
14             for certain capital improvement projects for the state fair board, de-
15             partment of social and rehabilitation services, Kansas state school for
16             the blind, Kansas state school for the deaf, department of corrections,
17             state historical society, insurance department, department of admin-
18             istration, department of commerce and housing, Fort Hays state uni-
19             versity, Kansas state university, Kansas state university extension sys-
20             tems and agriculture research programs, Kansas state university
21             veterinary medical center, Emporia state university, Pittsburg state
22             university, university of Kansas, university of Kansas medical center,
23             Wichita state university, department of human resources, Kansas com-
24             mission on veterans affairs, attorney general--Kansas bureau of inves-
25             tigation, Kansas highway patrol, adjutant general, department of wild-
26             life and parks and juvenile justice authority; authorizing the initiation
27             and completion of certain capital improvement projects; and directing
28             or authorizing certain disbursements and acts incidental to the
29             foregoing.
30            
31       Be it enacted by the Legislature of the State of Kansas:
32           Section 1. (a) For the fiscal years ending June 30, 1998, and June 30,
33       1999, appropriations are hereby made, restrictions and limitations are
34       hereby imposed, and transfers, disbursements and acts incidental to the
35       foregoing are hereby directed or authorized to initiate and complete cap-
36       ital improvement projects as provided in this act.
37           (b) The agencies named in this act are hereby authorized to initiate
38       and complete the capital improvement projects specified and authorized
39       by this act or for which appropriations are made by this act, subject to
40       the restrictions and limitations imposed by this act.
41           (c) This act shall not be subject to the provisions of subsection (a) of
42       K.S.A. 75-6702 and amendments thereto.

  1           Sec. 2.
  2      
STATE FAIR BOARD
  3           (a) There is appropriated for the above agency from the following
  4       special revenue fund or funds for the fiscal year ending June 30, 1999,
  5       all moneys now or hereafter lawfully credited to and available in such
  6       fund or funds, except that expenditures other than refunds authorized by
  7       law shall not exceed the following:
8       State fair capital improvements fund No limit
9       Grandstand renovation project fund No limit
10       Grandstand cost of issuance fund No limit
11       Grandstand principal and interest fund No limit
12       Grandstand renovation reserve fund No limit
13       Grandstand rebate fund No limit
14       Grandstand renovation surplus fund No limit
15       Grandstand contingency fund No limit
16       SBSF -- encampment building renovation fund No limit
17       EDIF -- encampment renovation fund No limit
18           (b) In addition to the other purposes for which expenditures may be
19       made from the state budget stabilization fund for fiscal year 1999, ex-
20       penditures may be made by the above agency from the state budget sta-
21       bilization fund for fiscal year 1999 for the following specified purpose or
22       purposes, subject to the expenditure limitations prescribed therefor:
23       New commercial building $848,000
24       Provided, That all expenditures by the above agency from the state budget stabilization fund
25       for fiscal year 1999 for the new commercial building shall be in addition to any expenditure
26       limitation imposed on the state budget stabilization fund for fiscal year 1999.
27           Sec. 3.
28      
DEPARTMENT OF SOCIAL AND REHABILITATION SERVICES
29           (a) There is appropriated for the above agency from the state insti-
30       tutions building fund for the fiscal year ending June 30, 1999, for the
31       capital improvement project or projects specified as follows:
32       Rehabilitation and repair projects $3,965,000
33       Provided, That the secretary of social and rehabilitation services is hereby authorized to
34       transfer moneys during fiscal year 1999 from the rehabilitation and repair projects account
35       to a rehabilitation and repair account for any institution, as defined by K.S.A. 76-12a01 or
36       76-12a18 and amendments thereto, for projects approved by the secretary of social and
37       rehabilitation services: Provided further, That expenditures also may be made from this
38       account during fiscal year 1999 for the purposes of rehabilitation and repair for facilities of
39       the department of social and rehabilitation services other than any institution, as defined by
40       K.S.A. 76-12a01 or 76-12a18 and amendments thereto.
41           (b) In addition to the purposes for which expenditures may be made
42       by the above agency from the other state fees fund for fiscal year 1999,
43       expenditures may be made by the above agency from the other state fees

  1       fund for fiscal year 1999 for the following capital improvement project or
  2       projects, subject to the expenditure limitations prescribed therefor:
3       Area office rehabilitation and repair $106,000
  4       Provided, That expenditures from the area office rehabilitation and repair account shall be
  5       in addition to any expenditure limitation imposed on the other state fees fund for fiscal year
  6       1999.
  7           Sec. 4.

KANSAS STATE SCHOOL FOR THE BLIND
  9           (a) There is appropriated for the above agency from the state insti-
10       tutions building fund for the fiscal year ending June 30, 1999, for the
11       capital improvement project or projects specified as follows:
12       Rehabilitation and repair projects $289,654
13           Sec. 5.

KANSAS STATE SCHOOL FOR THE DEAF
15           (a) There is appropriated for the above agency from the state insti-
16       tutions building fund for the fiscal year ending June 30, 1999, for the
17       capital improvement project or projects specified as follows:
18       Rehabilitation and repair projects $349,078 $374,078
19       Install air conditioning in Roth dormitories and Roberts academicbuilding $154,735
20           Sec. 6.

DEPARTMENT OF CORRECTIONS
22           (a) There is appropriated for the above agency from the state general
23       fund for the fiscal year ending June 30, 1999, for the capital improvement
24       project or projects specified as follows:
25       Debt service payment for the revenue refunding bond issue $6,802,000
26       Debt service payment for the Wichita work release facility bond issue $163,000
27       Debt service payment for the Ellsworth correctional facility at Ellsworth,Kansas $1,675,000
28       Debt service payment for the El Dorado correctional facility site utilitiesreplacement project $1,258,000
29       Any unencumbered balance in each of the following accounts in excess of $100 as of June
30       30, 1998, is hereby reappropriated for fiscal year 1999: Capacity expansion planning.
31           (b) (1) In addition to the other purposes for which expenditures may
32       be made by the above agency from the capacity expansion planning ac-
33       count of the state general fund for fiscal year ending 1998, as authorized
34       by section 45(a) of chapter 192 of the 1997 Session Laws of Kansas or by
35       this or other appropriation act of the 1998 regular session of the legisla-
36       ture, expenditures may be made by the above agency for fiscal year 1998
37       from the capacity expansion planning account of the state general fund
38       for the following capital improvement project or projects: Planning for
39       new reception and diagnostic unit; planning for new construction for a
40       200-bed unit at Hutchinson correctional facility.

  1           (2) In addition to the other purposes for which expenditures may be
  2       made by the above agency from the capacity expansion planning account
  3       of the state general fund for fiscal year 1999, as authorized by this or
  4       other appropriation act of the 1998 regular session of the legislature,
  5       expenditures may be made by the above agency for fiscal year 1999 from
  6       unencumbered balance as of June 30, 1998, in the capacity expansion
  7       planning account of the state general fund for the following capital im-
  8       provement project or projects: Planning for new reception and diagnostic
  9       unit; planning for new construction for a 200-bed unit at Hutchinson
10       correctional facility: Provided, That expenditures for such projects from
11       unencumbered balance in the capacity expansion planning account of the
12       state general fund shall not exceed the unencumbered balance in such
13       account as of June 30, 1998.
14           (c) There is appropriated for the above agency from the correctional
15       institutions building fund for the fiscal year or years specified, for the
16       capital improvement project or projects specified as follows:

repair of correctional institutions

20           For the fiscal year ending June 30, 1999 $4,253,225
21       Provided, That the secretary of corrections is hereby authorized to transfer moneys during
22       fiscal year 1999 from the capital improvements -- rehabilitation, remodeling, renovation
23       and repair of correctional institutions account of the correctional institutions building fund
24       to an account or accounts of the correctional institutions building fund of any institution or
25       facility under the jurisdiction of the secretary of corrections to be expended during fiscal
26       year 1999 by the institution or facility for capital improvement projects, including security
27       improvement projects and hazardous waste cleanup at Lansing correctional facility, ap-
28       proved by the secretary of corrections: Provided, however, That the aggregate of all transfers
29       from this account to an account or accounts of any institution under the jurisdiction of the
30       secretary of corrections to be expended in fiscal year 1998 and fiscal year 1999 for the
31       purposes of capacity expansion planning for planning for new reception and diagnostic unit
32       or for planning for new construction for a 200-bed unit at Hutchinson correctional facility,
33       shall not exceed $87,630.
34       Debt service payment for the revenue refunding bond issue
35           For the fiscal year ending June 30, 1999 $500,000
36           (d) In addition to the other purposes for which expenditures may be
37       made by the above agency from the correctional industries fund for fiscal
38       year 1999, expenditures may be made by the above agency from the
39       correctional industries fund for fiscal year 1999 for the following capital
40       improvement project or projects, subject to the expenditure limitations
41       prescribed therefor:
42       Construct industries building at Lansing $876,025
43        (e) On the effective date of this act, the appropriation of all

  1       moneys credited to and available in the correctional facilities ex-
  2       pansion projects revenue fund established by section 45(g) of chap-
  3       ter 192 of the 1997 Session Laws of Kansas for the capital improve-
  4       ments projects for expansion at Hutchinson correctional facility is
  5       hereby lapsed and the correctional facilities expansion projects
  6       revenue fund is hereby abolished.
  7           (e) (f) There is appropriated for the above agency from the following
  8       special revenue fund or funds for the fiscal year ending June 30, 1999,
  9       all moneys now or hereafter lawfully credited to and available in such
10       fund or funds, except that expenditures other than refunds authorized by
11       law shall not exceed the following:
12       Violent offenders incarceration and truth in sentencing incentive grants-- federal fund No limit
13       Ellsworth correctional facility -- principal and interest fund -- KDFA Bbonds No limit
14       Lease revenue bond issue -- principal and interest fund -- J Bonds No limit

16           Sec. 7.

STATE HISTORICAL SOCIETY
18           (a) There is appropriated for the above agency from the state general
19       fund for the fiscal year ending June 30, 1999, for the capital improvement
20       project or projects specified as follows:
21       Rehabilitation and repair projects $334,573
22           (b) There is appropriated for the above agency from the following
23       special revenue fund or funds for the fiscal year ending June 30, 1999,
24       all moneys now or hereafter lawfully credited to and available in such
25       fund or funds, except that expenditures other than refunds authorized by
26       law shall not exceed the following:
27       EDIF first territorial capitol renovation project fund $71,000
28       Provided, That no expenditures shall be made from the EDIF first territorial capitol reno-
29       vation project fund except upon approval of the state finance council acting on this matter
30       which is hereby characterized as a matter of legislative delegation and subject to the guide-
31       lines prescribed by subsection (c) of K.S.A. 75-3711c and amendments thereto: Provided,
32       however, That, if the secretary of the state historical society has entered into a signed
33       agreement with a responsible party that would transfer from the state the future daily op-
34       eration and maintenance of the first territorial capitol historical site, then the state finance
35       council shall approve expenditures from this fund for the first territorial capitol renovation
36       project.
37           Sec. 8.

INSURANCE DEPARTMENT
39           (a) There is appropriated for the above agency from the following
40       special revenue fund or funds for the fiscal year ending June 30, 1999,

  2       fund or funds, except that expenditures shall not exceed the following:

DEPARTMENT OF ADMINISTRATION
  7           (a) There is appropriated for the above agency from the state general
  8       fund for the fiscal year ending June 30, 1999, for the capital improvement
  9       project or projects specified as follows:
10       Energy conservation improvements -- debt service $3,127,981
11       Memorial hall -- debt service $295,000
12       Paint and grounds shop -- debt service $14,864
13       Cedar Crest repair and renovation $380,400
14       [judicial center carpet replacement $64,000
15       [judicial center rehabilitation and repair $50,000
16       [Rehabilitation and repair--statehouse and cedar crest $50,000]
17       Any unencumbered balance in excess of $100 as of June 30, 1998, in each of the following
18       capital improvement accounts is hereby reappropriated for fiscal year 1999: Rehabilitation
19       and repair -- statehouse, judicial center and governor's residence; fire and safety alarms --
20       statehouse; planning for memorial hall renovation; roof repair at center section and rotunda
21       -- statehouse; cedar crest repair and renovation; memorial hall bond anticipation note.
22           (b) There is appropriated for the above agency from the following
23       special revenue fund or funds for the fiscal year ending June 30, 1999,
24       all moneys now or hereafter lawfully credited to and available in such
25       fund or funds, except that expenditures shall not exceed the following:
26       Master lease program fund No limit
27       State buildings depreciation fund $0
28           (c) In addition to the other purposes for which expenditures may be
29       made from the state budget stabilization fund for fiscal year 1999, ex-
30       penditures may be made by the above agency from the state budget sta-
31       bilization fund for fiscal year 1999 for the following specified purpose or
32       purposes, subject to the expenditure limitations prescribed therefor:
33       Statehouse elevators renovation $347,000
34       Statehouse grounds & facility improvements $750,000
35       Provided, That all expenditures by the above agency from the state budget stabilization fund
36       for fiscal year 1999 for the statehouse elevators renovation and statehouse grounds & facility
37       improvements shall be in addition to any expenditure limitation imposed on the state budget
38       stabilization fund for fiscal year 1999.
39           (d) In addition to the other purposes for which expenditures may be
40       made by the above agency from the building and ground fund for fiscal
41       year 1999, expenditures may be made by the above agency from any
42       unencumbered balance as of June 30, 1998, in each of the following
43       capital improvement accounts of the building and ground fund: Parking

  1       lot rehabilitation and repair: Provided, That expenditures for fiscal year
  2       1999 from the unencumbered balance in any such account shall not ex-
  3       ceed the amount of the unencumbered balance in such account on June
  4       30, 1998.
  5           (e) In addition to the other purposes for which expenditures may be
  6       made by the above agency from the state buildings depreciation fund for
  7       fiscal year 1999, expenditures may be made by the above agency from
  8       the following capital improvement account or accounts of the state build-
  9       ings depreciation fund during fiscal year 1999 for the following capital
10       improvement project or projects, subject to the expenditure limitations
11       prescribed therefor:
12       Memorial & Landon steam tunnel and walkway planning andconstruction $40,000
13       Docking fire suppression system installation $550,000
14       Landon fire suppression system installation $450,000
15       Docking renovation -- debt service $171,100

17       Provided, That all expenditures from each such capital improvement account shall be in
18       addition to any expenditure limitation imposed on the state buildings depreciation fund for
19       fiscal year 1999.
20           (f) In addition to the other purposes for which expenditures may be
21       made by the above agency from the state buildings depreciation fund for
22       fiscal year 1999, expenditures may be made by the above agency from
23       the state buildings depreciation fund from the unencumbered balance as
24       of June 30, 1998, in each capital improvement account of the state build-
25       ings depreciation fund for one or more projects approved for prior fiscal
26       years: Provided, That expenditures from the unencumbered balance in
27       any such account shall not exceed the amount of the unencumbered bal-
28       ance in such account on June 30, 1998: Provided further, That all ex-
29       penditures from any such account shall be in addition to any expenditure
30       limitation imposed on the state buildings depreciation fund for fiscal year
31       1999.
32           (g) In addition to the other purposes for which expenditures may be
33       made by the above agency from the state buildings operating fund for
34       fiscal year 1999, expenditures may be made by the above agency from
35       the following capital improvement account or accounts of the state build-
36       ings operating fund during fiscal year 1999 for the following capital im-
37       provement project or projects, subject to the expenditure limitations pre-
38       scribed therefor:

41           (h) In addition to the other purposes for which expenditures may be

  2       year 1999, expenditures may be made by the above agency from the
  3       following capital improvement account or accounts of the motor pool
  4       service fund during fiscal year 1999 for the following capital improvement
  5       project or projects, subject to the expenditure limitations prescribed
  6       therefor:

  8       Provided, That all expenditures by the above agency from the motor pool service fund for
  9       fiscal year 1999 for motor pool shop -- debt service shall be in addition to any expenditure

11           (i) In addition to the other purposes for which expenditures may be
12       made from the intragovernmental printing service fund for fiscal year
13       1999, expenditures may be made by the above agency from the following
14       capital improvement account or accounts of the intragovernmental print-
15       ing service fund during fiscal year 1999 for the following capital improve-
16       ment project or projects, subject to the expenditure limitations prescribed
17       therefor:

19           Sec. 10.

DEPARTMENT OF COMMERCE AND HOUSING
21           (a) In addition to the other purposes for which expenditures may be
22       made from the Kansas economic development endowment account of the
23       state economic development initiatives fund for fiscal year 1999, moneys
24       may be expended by the above agency from the Kansas economic devel-
25       opment endowment account of the state economic development initia-
26       tives fund during the fiscal year 1999 for the following capital improve-
27       ment project or projects, subject to the expenditure limitations prescribed
28       therefor:
29       Rehabilitation and repair -- travel information centers $35,000
30       Provided, That all expenditures by the above agency from the rehabilitation and repair --
31       travel information centers subaccount of the Kansas economic development endowment
32       account of the state economic development initiatives fund for fiscal year 1999 shall be in
33       addition to any expenditure limitation imposed on the Kansas economic development en-
34       dowment account of the state economic development initiatives fund for fiscal year 1999.
35           (b) In addition to the other purposes for which expenditures may be
36       made from the Kansas economic development endowment account of the
37       state economic development initiatives fund, expenditures may be made
38       from the construct Olathe travel information center subaccount of the
39       Kansas economic development endowment account of the state economic
40       development initiatives fund during the fiscal year ending June 30, 1999:
41       Provided, That such expenditures shall not exceed the amount of the
42       unencumbered balance in such subaccount on June 30, 1998: Provided
43       further, That all expenditures from the unencumbered balance of any

  1       such subaccount shall be in addition to any expenditure limitation im-
  2       posed on the total expenditures from the Kansas economic development
  3       endowment account of the state economic development initiatives fund
  4       for fiscal year 1999.
  5           Sec. 11.

FORT HAYS STATE UNIVERSITY
  7           (a) There is appropriated for the above agency from the following
  8       special revenue fund or funds for the fiscal year ending June 30, 1999,
  9       all moneys now or hereafter lawfully credited to and available in such
10       fund or funds, except that expenditures shall not exceed the following:

18       and required reserves for the payment of principal and interest on the bonds: Provided
19       further, That such capital improvement project is hereby approved for Kansas state univer-
20       sity for the purposes of subsection (b) of K.S.A. 74-8905 and amendments thereto and the
21       authorization of the issuance of bonds by the Kansas development finance authority in
22       accordance with that statute: And provided further, That all moneys received from the
23       issuance of any such bonds shall be deposited in the state treasury to the credit of this fund.

31       vided, however, That expenditures from this fund for such capital improvement project shall
32       not exceed $10,500,000 plus all amounts required for costs of any bond issuance, costs of
33       interest on any bond issued or obtained for such capital improvement project and any
34       required reserves for payment of principal and interest on any bond: Provided further, That
35       such capital improvement project is hereby approved for Kansas state university for the
36       purposes of subsection (b) of K.S.A. 74-8905 and amendments thereto and the authorization
37       of the issuance of bonds by the Kansas development finance authority in accordance with
38       that statute: And provided further, That all moneys received from the issuance of any such
39       bonds shall be deposited in the state treasury to the credit of this fund.
40       Football stadium expansion -- special revenue fund No limit
41       Provided, That Kansas state university may make expenditures from the football
42       stadium expansion -- special revenue fund for the capital improvement project to
43       expand the football stadium in addition to the expenditure of other moneys appro-

  1       priated therefor: Provided, however, That expenditures from this fund for such cap-
  2       ital improvement project shall not exceed $16,000,000 plus all amounts required
  3       for costs of any such bond issuance, costs of interest on any bonds issued or obtained
  4       for such capital improvement projects and any required reserves for payment of
  5       principal and interest on any bond: Provided further, That such capital improvement
  6       project is hereby approved for Kansas state university for the purposes of subsec-
  7       tion (b) of K.S.A. 74-8905 and amendments thereto and the authorization of the
  8       issuance of bonds by the Kansas development finance authority in accordance with
  9       that statute: And provided further, That all moneys received from the issuance of any
10       such bonds shall be deposited in the state treasury to the credit of this fund.
11           (c) On or before July 10, 1998, and on or before the 10th day of each
12       month thereafter during fiscal year 1999, the director of accounts and
13       reports shall transfer from the state general fund to the student coliseum
14       bond fee fund interest earnings based on: (1) The average daily balance
15       of moneys in the student coliseum bond fee fund for the preceding
16       month, and (2) the net earnings rate of the pooled money investment
17       portfolio for the preceding month.
18           (d) In addition to the other purposes for which expenditures may be
19       made by the above agency from the restricted fees fund for the fiscal year
20       ending June 30, 1999, expenditures may be made by the above agency
21       from the appropriate account or accounts of the restricted fees fund dur-
22       ing fiscal year 1999 for the following capital improvement project or pro-

24       made from the state budget stabilization fund for fiscal year 1999, ex-
25       penditures may be made by the above agency from the state budget sta-
26       bilization fund for fiscal year 1999 for the following specified purpose or
27       purposes, subject to the expenditure limitations prescribed therefor:

  3       Provided, That the university of Kansas medical center may make expenditures from the
  4       construct and equip center for health in aging fund for the capital improvement project to
  5       construct the center for health in aging in addition to the expenditure of other moneys
  6       appropriated therefor: Provided, however, That expenditures from this fund for such capital
  7       improvement project shall not exceed $8,000,000 plus all amounts required for costs of any
  8       bond issuance, costs of interest on any bond issued or obtained for such capital improvement
  9       project and any required reserves for payment of principal and interest on any bond: Pro-
10       vided further, That the above agency may transfer moneys for fiscal year 1999 from appro-
11       priate accounts of the sponsored research overhead fund to this fund for such capital im-
12       provement project or for debt service for such capital improvement project: And provided
13       further, That such capital improvement project is hereby approved for the university of
14       Kansas medical center for the purposes of subsection (b) of K.S.A. 74-8905 and amendments
15       thereto and the authorization of the issuance of bonds by the Kansas development finance
16       authority in accordance with that statute: And provided further, That all moneys received
17       from the issuance of any such bonds shall be deposited in the state treasury to the credit of
18       this fund.
19       Construct and equip research support facility fund No limit
20       Provided, That the university of Kansas medical center may make expenditures from the
21       construct and equip research support facility fund for the capital improvement project to
22       construct an addition to the research support facility in addition to the expenditure of other
23       moneys appropriated therefor: Provided, however, That expenditures from this fund for
24       such capital improvement project shall not exceed $3,250,000 plus all amounts required for
25       costs of any bond issuance, costs of interest on any bond issued or obtained for such capital
26       improvement project and any required reserves for payment of principal and interest on
27       any bond: Provided further, That the above agency may transfer moneys for fiscal year 1999
28       from appropriate accounts of the sponsored research overhead fund to this fund for such
29       capital improvement project or for debt service for such capital improvement project: And
30       provided further, That such capital improvement project is hereby approved for the uni-
31       versity of Kansas medical center for the purposes of subsection (b) of K.S.A. 74-8905 and
32       amendments thereto and the authorization of the issuance of bonds by the Kansas devel-
33       opment finance authority in accordance with that statute: And provided further, That all
34       moneys received from the issuance of any such bonds shall be deposited in the state treasury
35       to the credit of this fund.
36           (b) During the fiscal year ending June 30, 1999, the director of ac-
37       counts and reports shall transfer amounts certified by the chancellor of
38       the university of Kansas from the sponsored research overhead fund to
39       the biomedical research principal and interest sinking fund.
40           (c) During the fiscal year ending June 30, 1999, the university of
41       Kansas medical center is hereby authorized to make expenditures to raze
42       portions of building no. 13 (the Eleanor Taylor administration building).
43           (d) During the fiscal year ending June 30, 1999, the university of

  1       Kansas medical center is hereby authorized to make expenditures to raze
  2       building no. 4 (Hinch hall).
  3           (e) On July 1, 1998, any unencumbered balance in each of the fol-
  4       lowing accounts of the Kansas educational building fund is hereby lapsed:
  5       Ventilating and air conditioning repairs to Bell memorial hospital -- phase
  6       III.
  7           Sec. 19.
  8      
WICHITA STATE UNIVERSITY
  9           (a) There is appropriated for the above agency from the following
10       special revenue fund or funds for the fiscal year ending June 30, 1999,
11       all moneys now or hereafter lawfully credited to and available in such
12       fund or funds, except that expenditures shall not exceed the following:
13       On-campus parking construction and maintenance fund No limit
14           Sec. 20.
15      
DEPARTMENT OF HUMAN RESOURCES
16           (a) In addition to the other purposes for which expenditures may be
17       made by the above agency from the employment security administration
18       fund for fiscal year 1998, and in addition to capital improvement projects
19       authorized by section 19 of chapter 150 of the 1997 Session Laws of
20       Kansas, expenditures may be made by the above agency from the em-
21       ployment security administration fund for fiscal year 1998 for capital im-
22       provement projects: Provided, That such expenditures from this fund for
23       capital improvement projects shall be made only for the following capital
24       improvement purposes: (1) Renovating the Wichita office into a phone
25       center operation, and (2) creating additional parking for the main office
26       of the department of human resources located at 401 Topeka Ave, To-
27       peka, Kansas: Provided further, That expenditures from this fund for fis-
28       cal year 1998 for capital improvement projects for such capital improve-
29       ment purposes shall not exceed $244,000: And provided further, That all
30       expenditures from this fund for capital improvement projects for such
31       capital improvement purposes shall be in addition to any expenditure
32       limitation imposed on the employment security administration fund for
33       fiscal year 1998.
34           (b) In addition to the other purposes for which expenditures may be
35       made by the above agency from the employment security administration
36       fund for fiscal year 1999, expenditures may be made by the above agency
37       from the employment security administration fund from moneys made
38       available to the state under section 903 of the federal social security act,
39       as amended, during fiscal year 1999: Provided, That expenditures from
40       this fund during fiscal year 1999 of moneys made available to the state
41       under section 903 of the federal social security act, as amended, shall be
42       made only for the following capital improvement purposes: (1) For major
43       maintenance of existing buildings used by the department of human re-

  1       sources for employment security purposes; (2) for paving, landscaping
  2       and acquiring fixed equipment as may be required for the use and op-
  3       eration of such buildings; (3) for the purposes of purchasing real property
  4       adjoining or near the main office of the department of human resources
  5       located at 401 Topeka Avenue, Topeka, Kansas, for parking lot expansion
  6       for such office; or (4) for any combination of these purposes: Provided
  7       further, That expenditures from this fund during fiscal year 1999 of mon-
  8       eys made available to the state under section 903 of the federal social
  9       security act, as amended, for such capital improvement purposes shall not
10       exceed $123,500 plus the amounts of unencumbered balances as of June
11       30, 1998, for capital improvement projects approved for fiscal years prior
12       to fiscal year 1999: And provided further, That all expenditures from this
13       fund for any such capital improvement purposes or projects shall be in
14       addition to any expenditure limitation imposed on the employment se-
15       curity administration fund for fiscal year 1999.
16           Sec. 21.

KANSAS COMMISSION ON VETERANS AFFAIRS
18           (a) There is appropriated for the above agency from the state insti-
19       tutions building fund for the fiscal year ending June 30, 1999, for the
20       capital improvement project or projects specified as follows:
21       Repair and rehabilitation projects $110,000
22       Halsey hall remodeling $200,000
23       Provided, That no expenditures shall be made from the Halsey hall remodeling account to
24       construct an enclosed smoking area at Halsey hall.
25           (b) There is appropriated for the above agency from the following
26       special revenue fund or funds for the fiscal year ending June 30, 1999,
27       all moneys now or hereafter lawfully credited to and available in such
28       fund or funds, except that expenditures shall not exceed the following:
29       Veterans' home federal construction grant fund $0
30       Provided, That all moneys received by the above agency as federal grants for the purposes
31       of construction and remodeling at the Kansas veterans' home, which grants are hereby
32       authorized to be applied for and received by the above agency, shall be deposited in the
33       state treasury to the credit of the Veterans' home federal construction grant fund.

36           (a) There is appropriated for the above agency from the state general

  8       for the Kansas highway patrol training center at Salina for the bonds
  9       issued for such project pursuant to subsection (b) of section 6 of chapter

11           (b) In addition to the other purposes for which expenditures may be
12       made from the highway patrol training center fund for fiscal year 1999,
13       expenditures may be made by the above agency from the highway patrol
14       training center fund for fiscal year 1999 for the following capital improve-
15       ment project or projects, subject to the expenditure limitation prescribed
16       therefor:

18       Provided, That all expenditures from each such capital improvement account shall be in

22       made by the above agency from the motor carrier inspection fund for
23       fiscal year 1999, expenditures may be made by the above agency from
24       the motor carrier inspection fund during fiscal year 1999 for the following
25       capital improvement project or projects, subject to the expenditure lim-
26       itations prescribed therefor:

35       capital improvement accounts of the state general fund is hereby reappropriated for fiscal
36       year 1999: Prairie Spirit rails-to-trails project; flood damage repair; rehabilitation and re-

38       Matching grant for development of wetlands project at Milfordreservoir $361,512
39       Provided, That expenditures from this account may be made by the secretary of
40       wildlife and parks upon verification by the chairperson of WILDSCAPE that federal
41       funds are available from the U.S. army corps of engineers for development of the
42       Milford wetlands: Provided, however, That funds provided by the Kansas department

27           (d) On July 1, 1998, or as soon thereafter as moneys are available,
28       the director of accounts and reports shall transfer $200,000 from the state
29       highway fund of the department of transportation to the bridge mainte-
30       nance fund of the department of wildlife and parks.
31           (e) In addition to the other purposes for which expenditures may be
32       made by the above agency from the migratory waterfowl propagation and
33       protection fund for fiscal year 1999, expenditures may be made by the
34       above agency for fiscal year 1999 from the unencumbered balance as of
35       June 30, 1998, in each existing capital improvement account of the mi-
36       gratory waterfowl propagation and protection fund: Provided, That all
37       expenditures from the unencumbered balance of any such account shall
38       not exceed the amount of the unencumbered balance in such account on
39       June 30, 1998: Provided further, That all expenditures from the unen-
40       cumbered balance of any such account shall be in addition to any ex-
41       penditure limitation imposed on the migratory waterfowl propagation and

15       of commerce and housing to the EDIF -- river recreation and
16       access fund of the department of wildlife and parks.
17           (g) In addition to the other purposes for which expenditures may be
18       made by the above agency from the boating fee fund for fiscal year 1999,
19       expenditures may be made by the above agency for fiscal year 1999 from
20       the unencumbered balance as of June 30, 1998, in each existing capital
21       improvement account of the boating fee fund: Provided, That expendi-
22       tures from the unencumbered balance of any such existing capital im-
23       provement account shall not exceed the amount of the unencumbered
24       balance in such account on June 30, 1998: Provided further, That all
25       expenditures from the unencumbered balance of any such account shall
26       be in addition to any expenditure limitation imposed on the boating fee
27       fund for fiscal year 1999 and shall be in addition to any other expenditure
28       limitation imposed on any such account of the boating fee fund for fiscal

30           (h) In addition to the other purposes for which expenditures may be
31       made from the state budget stabilization fund for fiscal year 1999, ex-

25       the unencumbered balance as of June 30, 1998, in each existing capital
26       improvement account of the wildlife fee fund: Provided, That expendi-
27       tures from the unencumbered balance of any such existing capital im-
28       provement account shall not exceed the amount of the unencumbered

10       be made by the above agency from the wildlife conservation fund for
11       fiscal year 1999, expenditures may be made by the above agency for fiscal
12       year 1999 from the unencumbered balance as of June 30, 1998, in each
13       existing capital improvement account of the wildlife conservation fund:
14       Provided, That expenditures from the unencumbered balance of any such
15       existing capital improvement account shall not exceed the amount of the
16       unencumbered balance in such account on June 30, 1998: Provided fur-
17       ther, That all expenditures from the unencumbered balance of any such
18       account shall be in addition to any expenditure limitation imposed on the
19       wildlife conservation fund for fiscal year 1999 and shall be in addition to
20       any other expenditure limitation imposed on any such account of the
21       wildlife conservation fund for fiscal year 1999.
22           (n) (m) In addition to the other purposes for which expenditures may
23       be made by the above agency from the parks fee fund for fiscal year 1999,
24       expenditures may be made by the above agency for fiscal year 1999 from
25       the unencumbered balance as of June 30, 1998, in each existing capital
26       improvement account of the parks fee fund: Provided, That expenditures
27       from the unencumbered balance of any such existing capital improvement
28       account shall not exceed the amount of the unencumbered balance in
29       such account on June 30, 1998: Provided further, That all expenditures
30       from the unencumbered balance of any such account shall be in addition
31       to any expenditure limitation imposed on the parks fee fund for fiscal
32       year 1999.
33           (o) (n) In addition to the other purposes for which expenditures may
34       be made by the above agency from the nongame wildlife improvement
35       fund for fiscal year 1999, expenditures may be made by the above agency
36       for fiscal year 1999 from the unencumbered balance as of June 30, 1998,
37       in each existing capital improvement account of the nongame wildlife
38       improvement fund: Provided, That expenditures from the unencumbered
39       balance of any such existing capital improvement account shall not exceed
40       the amount of the unencumbered balance in such account on June 30,
41       1998: Provided further, That all expenditures from the unencumbered
42       balance of any such account shall be in addition to any expenditure lim-
43       itation imposed on the nongame wildlife improvement fund for fiscal year

  4        (o) During the fiscal year ending June 30, 1999, any expendi-
  5       tures by the department of wildlife and parks from any moneys
  6       appropriated for fiscal year 1999, for wetlands acquisition shall be
  7       for the acquisition of existing wetlands that are adjacent to state-
  8       owned wetlands in Barton county or McPherson county: Provided,
  9       That, as used in this subsection, wetlands are defined as areas that
10       have a predominance of hydric soils and that are inundated or
11       saturated by surface or groundwater at a frequency and duration
12       sufficient to support, and under normal circumstances do support,
13       a prevalence of hydrophytic vegetation typically adapted for life
14       in saturated soil conditions.
15           (p) During the fiscal year ending June 30, 1999, any expendi-
16       tures by the department of wildlife and parks from any moneys
17       appropriated for fiscal year 1999, for land acquisition related to
18       the playa lakes project shall be for lands which are adjacent to
19       playa lakes properties that are already owned by the state: Pro-
20       vided, That no pumping of groundwater may be done on any such
21       newly acquired properties.
22           Sec. 26.

JUVENILE JUSTICE AUTHORITY
24           (a) There is appropriated for the above agency from the state insti-
25       tutions building fund for the fiscal year ending June 30, 1999, for the
26       capital improvement project or projects specified as follows:

32       fund to an account or accounts of the state institutions building fund of any institution or
33       facility under the jurisdiction of the commissioner of juvenile justice to be expended during
34       fiscal year 1999 by the institution or facility for capital improvement projects approved by
35       the commissioner of juvenile justice.
36           Sec. 27. Appeals to exceed limitations. Upon written application to
37       the governor and approval of the state finance council, expenditures from
38       special revenue funds may exceed the amounts specified in this act.
39           Sec. 28. Savings. Any unencumbered balance as of June 30, 1998, in
40       any special revenue fund, or account thereof, which is not otherwise spe-
41       cifically appropriated or limited by this or other appropriation act of the
42       1998 regular session of the legislature, is hereby appropriated for the
43       fiscal year ending June 30, 1999, for the same use and purpose as the

  1       same was heretofore appropriated.
  2           Sec. 29. Any correctional institutions building fund appropriation
  3       heretofore appropriated to any state agency named in this or other ap-
  4       propriation act of the 1998 regular session of the legislature, and having
  5       an unencumbered balance as of June 30, 1998, in excess of $100 is hereby
  6       reappropriated for the fiscal year ending June 30, 1999, for the same uses
  7       and purposes as originally appropriated unless specific provision is made
  8       for lapsing such appropriation.
  9           Sec. 30. Any Kansas educational building fund appropriation here-
10       tofore appropriated to any institution named in this or other appropriation
11       act of the 1998 regular session of the legislature and having an unencum-
12       bered balance as of June 30, 1998, in excess of $100 is hereby reappro-
13       priated for the fiscal year ending June 30, 1999, for the same use and
14       purpose as originally appropriated, unless specific provision is made for
15       lapsing such appropriation.
16           Sec. 31. Any state institutions building fund appropriation heretofore
17       appropriated to any state agency named in this or other appropriation act
18       of the 1998 regular session of the legislature and having an unencumbered
19       balance as of June 30, 1998, in excess of $100 is hereby reappropriated
20       for the fiscal year ending June 30, 1999, for the same use and purpose as
21       originally appropriated, unless specific provision is made for lapsing such
22       appropriation.
23           Sec. 32. Any Kansas special capital improvements fund appropriation
24       heretofore appropriated to any state agency named in this or other ap-
25       propriation act of the 1998 regular session of the legislature, and having
26       an unencumbered balance as of June 30, 1998, in excess of $100 is hereby
27       reappropriated for the fiscal year ending June 30, 1999, for the same use
28       and purpose as originally appropriated unless specific provision is made
29       for lapsing such appropriation.
30           Sec. 33. This act shall take effect and be in force from and after its
31       publication in the Kansas register.
