                    HOUSE BILL No. 2918           By Representatives Phill Kline and Garner           2-13             9             AN ACT concerning the attorney general; relating to requests for pro-
10             posals for the hiring of outside counsel.

12       Be it enacted by the Legislature of the State of Kansas:
13           Section 1. (a) When the attorney general deems it necessary to con-
14       tract with an attorney, attorneys or a law firm to appear for the state in
15       any action or proceeding, civil or criminal, when the state is an interested
16       party, the attorney general shall prepare a request for proposal to allow
17       any attorney, attorneys or law firm to respond. Such request for proposal
18       shall describe the legal services needed in as great detail as is necessary
19       with out violating any privileged information or relationship or revealing
20       any facts or information which would jeopardize such action or proceed-
21       ing.
22           (b) The attorney general shall adopt rules and regulations to establish
23       procedures for determining which response to a request for proposal will
24       best serve the needs of the state of Kansas. The attorney general shall
25       use such rules and regulations to determine which, if any, response to
26       accept and with which to contract.
27           (c) These contracts or responses to request for proposals shall not be
28       subject to the competitive bidding requirements of K.S.A. 75-3739 and
29       amendments thereto.
30           Sec. 2. This act shall take effect and be in force from and after its
31       publication in the statute book.
