                    HOUSE BILL No. 2916           By Representatives Garner and Sawyer           2-13             9             AN ACT concerning religious freedom.

11       Be it enacted by the Legislature of the State of Kansas:
12           Section 1. (a) The state or any political subdivision of the state shall
13       not restrict a person's exercise of religion under section 7 of the bill of
14       rights of the constitution of the state of Kansas even if the burden results
15       from a rule of general applicability, except as provided in subsection (b)
16       of this section.
17           (b) The state or any political subdivision of the state may restrict a
18       person's exercise of religion only if:
19           (1) The restriction is in the form of a rule of general applicability,
20       and does not intentionally discriminate against religion, or among relig-
21       ions; and
22           (2) the state or any political subdivision of the state authority proves
23       that application of the restriction to the person is essential to further a
24       compelling governmental interest, and is the least restrictive means of
25       furthering that compelling governmental interest.
26           (c) Nothing is this section shall be construed, nor is intended, to any
27       way lessen, diminish or limit the full protections provided in section 7 of
28       the bill of rights of the constitution of the state of Kansas.
29           (d) This section shall be known and may be cited as the religious
30       freedom restoration act.
31           Sec. 2. This act shall take effect and be in force from and after its
32       publication in the statute book.
