          14             AN ACT concerning school districts; relating to enrollment of nonresi-
15             dent pupils; [authorizing certain payments to certificated per-
16             sonnel to be made from inservice education funds;] amending
17             K.S.A. [72-9609 and K.S.A.] 1997 Supp. 72-1046a and repealing the
18             existing section [sections].

20       Be it enacted by the Legislature of the State of Kansas:
21           Section 1. K.S.A. 1997 Supp. 72-1046a is hereby amended to read
22       as follows: 72-1046a. (a) The board of education of any every any school
23       district is hereby authorized to may hereby is authorized to permit
24       pupils who are not residents of the school district to enroll in and attend
25       the schools of the district, up to the limit of a class, grade level, or building,
26       after reserving places for pupils entitled or required to attend such
27       schools. The board of education may shall permit such nonresident pupils
28       to attend school without charge or, subject to the provisions of subsection
29       (b), may charge such pupils for attendance at school to offset, totally or
30       in part, the costs of providing for such attendance. Amounts received
31       under this subsection by the board of education of a school district for
32       enrollment and attendance of pupils at school in regular educational pro-
33       grams shall be deposited in the general fund of the school district.
34           (b) Pupils who are not residents of a school district and are attending
35       the schools of the school district in accordance with the provisions of an
36       agreement entered into under authority of K.S.A. 72-8233, and amend-
37       ments thereto, shall not be charged for attendance at school. The costs
38       of providing for the attendance of such pupils at school shall be paid by
39       the school district of residence of the pupils in accordance with the pro-
40       visions of the agreement.
41           [Sec. 2. K.S.A. 72-9609 is hereby amended to read as follows:
42       72-9609. There is hereby established in every school district a fund
43       which shall be called the inservice education fund, which fund shall

  1       consist of all moneys deposited therein or transferred thereto ac-
  2       cording to law. All moneys received by the school district from
  3       whatever source for inservice education programs established un-
  4       der this act shall be credited to the fund established by this section.
  5       The expenses of a school district directly attributable to inservice
  6       education programs shall be paid from the inservice education
  7       fund. Direct payment to certificated personnel for attending staff devel-
  8       opment programs or activities conducted during noncontractual time of
  9       such personnel shall be an allowable expense to be paid from the inservice
10       education fund.]
11           Sec. 2 [3]. K.S.A. [72-9609 and K.S.A.] 1997 Supp. 72-1046a is

13           Sec. 3 [4]. This act shall take effect and be in force from and after
14       its publication in the statute book.
