            9             AN ACT concerning governmental ethics; relating to certain violations;
10             relating to past official acts.

12       Be it enacted by the Legislature of the State of Kansas:
13           Section 1. K.S.A. 46-215 through 46-293, and amendments thereto,
14       and K.S.A. 1997 Supp. 46-237a and section 2 shall be known and may be
15       cited as the state governmental ethics law.
16           Sec. 2. (a) No person shall accept or agree to accept any economic
17       opportunity, gift, loan, gratuity, special discount, favor, hospitality or serv-
18       ice for having given, in such person's official capacity as a state officer or
19       employee, a decision, opinion, recommendation or vote favorable to the
20       person giving or offering to give such economic opportunity, gift, loan,
21       gratuity, special discount, favor, hospitality or service.
22           (b) No person shall offer any economic opportunity, gift, loan, gra-
23       tuity, special discount, favor, hospitality or service to any other person for
24       a decision, opinion, recommendation or vote done in such other person's
25       official capacity as a state officer or employee that was favorable to the
26       person offering such economic opportunity, gift, loan, gratuity, special
27       discount, favor, hospitality or service.
28           (c) Subsections (a) and (b) shall not apply to the gifts or other benefits
29       conferred on account of a family or other personal, professional or busi-
30       ness relationship independent of the official status of the receiver.
31           (d) Violations of this section are punishable by civil fine as provided
32       by K.S.A. 46-288, and amendments thereto.
33           (e) Compensation for past official acts is a class B misdemeanor.
34           (f) The provisions of this section shall be subject to interpretation and
35       enforcement by the Kansas commission on governmental standards and
36       conduct in the manner provided by K.S.A. 46-253 through 46-263, and
37       amendments thereto.
38           Sec. 3. This act shall take effect and be in force from and after its
39       publication in the statute book.
