                              HOUSE BILL No. 2696           By Committee on Governmental Organization and Elections           1-23           10             AN ACT concerning water supply and distribution districts; relating to
11             the detachment of certain land.

13       Be it enacted by the Legislature of the State of Kansas:
14           Section 1. (a) If a petition, requesting detachment of land from a
15       water district organized under the provisions of K.S.A. 19-3501 et seq.,
16       and amendments thereto, is presented to the board of such district, the
17       board shall detach such land if:
18           (1) The land is located within the corporate limits of a city or within
19       the fringe area of a city, as defined by K.S.A. 19-270, and amendments
20       thereto;
21           (2) the petition is signed by the owners of at least 51% of the land
22       sought to be detached from the district; and
23           (3) the governing body of the city described in paragraph (1) finds,
24       by adoption of a resolution, that it would be more economical to the area
25       sought to be detached for the city to serve such area and consents, by
26       adoption of such resolution, to serve such area upon detachment by the
27       district.
28           (b) If the land is detached, any agreement entered into between the
29       board and the governing body of a water utility under subsection (b) of
30       K.S.A. 19-3512, and amendments thereto, shall be amended to reflect
31       the alteration of boundaries.
32           (c) A city providing services to such area shall not be required to
33       annex such area in order to serve such area.
34           Sec. 2. This act shall take effect and be in force from and after its
35       publication in the statute book.
