            9             AN ACT concerning controlled substances; relating to products contain-
10             ing ephedrine; amending K.S.A. 1997 Supp. 65-4113 and repealing the
11             existing section.

13       Be it enacted by the Legislature of the State of Kansas:
14           Section 1. K.S.A. 1997 Supp. 65-4113 is hereby amended to read as
15       follows: 65-4113. (a) The controlled substances or drugs, by whatever
16       official name, common or usual name, chemical name or brand name
17       designated, listed in this section are included in schedule V.
18           (b) Unless specifically excepted or unless listed in another schedule,
19       any material, compound, mixture or preparation containing the following
20       narcotic drug or its salts:

22		         Buprenorphine
   		 9064
23           (c) Any compound, mixture or preparation containing limited quan-
24       tities of any of the following narcotic drugs which also contains one or
25       more nonnarcotic active medicinal ingredients in sufficient proportion to
26       confer upon the compound, mixture or preparation valuable medicinal
27       qualities other than those possessed by the narcotic drug alone:
28           (1) Not more than 200 milligrams of codeine or any of its salts per
29       100 milliliters or per 100 grams.
30           (2) Not more than 100 milligrams of dihydrocodeine or any of its salts
31       per 100 milliliters or per 100 grams.
32           (3) Not more than 100 milligrams of ethylmorphine or any of its salts
33       per 100 milliliters or per 100 grams.
34           (4) Not more than 2.5 milligrams of diphenoxylate and not less than
35       25 micrograms of atropine sulfate per dosage unit.
36           (5) Not more than 100 milligrams of opium per 100 milliliters or per
37       100 grams.
38           (6) Not more than .5 milligram of difenoxin (9168) and not less than
39       25 micrograms of atropine sulfate per dosage unit.
40           (d) Unless specifically excepted or unless listed in another schedule,
41       any material, compound, mixture or preparation which contains any quan-
42       tity of the following substances having a stimulant effect on the central
43       nervous system, including its salts, isomers (whether optical, position or
44       geometric) and salts of such isomers whenever the existence of such salts,

  1       isomers and salts of isomers is possible within the specific chemical des-
  2       ignation:

4		         (1) Propylhexedrine (except when part of a compound used for nasaldecongestion which is authorized to be sold lawfully over thecounter without a prescription under the federal food, drug andcosmetic act, so long as it is used only for such purpose)

  7           (e) Unless specifically excepted or unless listed in another schedule,
  8       any product containing as ;ts single an ingredient the substance Ephed-
  9       rine.
10           Sec. 2. K.S.A. 1997 Supp. 65-4113 is hereby repealed.
11           Sec. 3. This act shall take effect and be in force from and after its
12       publication in the statute book.
