 9  AN ACT concerning the Kansas public employees retirement system and
10    systems thereunder; relating to postretirement benefit increase.

12  Be it enacted by the Legislature of the State of Kansas:
13    Section 1.  (a) The retirement benefit, pension or annuity payments
14  accruing after June 30, 1997, to each retirant and each local school an-
15  nuitant, shall be increased by an annual cost-of-living increase in an
16  amount equal to the percentage increase in the consumer price index for
17  all urban consumers published by the United States department of labor
18  for the preceding calendar year, except that such percentage increase
19  shall not exceed 2.0%, multiplied by the retirement benefit, pension or
20  annuity payment in effect on July 1, 1997, and each year thereafter, from
21  the retirant's retirement system and shall be paid by such retirement
22  system to the retirant and the local school annuitant during such period.
23    (b)  As used in this section:
24    (1)  ``Retirant'' means (A) any person who is a member of a retirement
25  system and who retires, (B) any person who is a special member of a
26  retirement system and who retires, (C) any person who is a joint annuitant
27  or beneficiary of any member described in clause (A) or any special mem-
28  ber described in clause (B), and (D) any insured disability benefit recip-
29  ient.
30    (2)  ``Retirement system'' means the Kansas public employees retire-
31  ment system, the Kansas police and firemen's retirement system, the state
32  school retirement system and the retirement system for judges.
33    (3)  ``Local school annuitant'' means (A) any person who is an annui-
34  tant with 10 or more years of service, who is receiving an annuity, whose
35  annuity is not included, in whole or in part, in payments made to such
36  school district under K.S.A. 72-5512b and amendments thereto and who
37  is not a member of a group I or of group II as defined in K.S.A. 72-5518
38  and amendments thereto, and (B) any person who is receiving an annuity
39  and who retired prior to September 1, 1981.
40    (c)  ``Insured disability benefit recipient'' means any person receiving
41  an insured disability benefit under K.S.A. 74-4927 and amendments
42  thereto.

 1    Sec. 2.  This act shall take effect and be in force from and after its
 2  publication in the statute book.
