10  AN ACT concerning prairie spirit rail trail; providing for a moratorium
11    on further development of phase II until April, 1998. III until funding
12    for construction is available; establishing a prairie spirit rail
13    trail task force.

15  Be it enacted by the Legislature of the State of Kansas:
16    Section 1.  Development of phase II III the prairie spirit rail trail
17  from Richmond to Ottawa the most southerly trailhead within the city
18  limits of Welda, Kansas to Iola, Kansas shall halt on the effective date
19  of this act and shall not resume until April, 1998. funding is available
20  for construction.
21    Sec. 2.  (a) There is hereby created the prairie spirit rail trail
22  advisory task force. Such task force shall consist of five members as
23  follows:
24    (1)  A representative of the Kansas farm bureau, appointed by
25  the farm bureau;
26    (2)  a representative of the Kansas livestock association, ap-
27  pointed by the association;
28    (3)  a representative of the governing body of either the city of
29  Ottawa or the city of Garnett, appointed by agreement of the gov-
30  erning bodies of such cities;
31    (4)  a representative of the board of county commissioners from
32  either Anderson or Franklin county; appointed by the county com-
33  missioners of the county other than the county from which the city
34  representative was appointed; and
35    (5)  the secretary of the Kansas department of wildlife and parks,
36  or the secretary's designee.
37    (b)  The secretary of the Kansas department of wildlife and parks
38  shall call and preside at the first meeting of the task force. At such
39  meeting the members of the task force shall elect a permanent chair-
40  person and vice-chairperson. The task force shall meet on the call
41  of the chairperson. All meetings of the task force shall be open pub-
42  lic meetings.
43    (c)  It shall be the duty of the task force to monitor and review

 1  any federal and state legislation and case law pertaining to the re-
 2  versionary interest of owners of property adjoining rail banked
 3  property and to develop a Kansas plan for compliance with federal
 4  and state law and to protect the reversionary interest of owners of
 5  property adjoining the prairie spirit rail trail.
 6    (d)  The task force shall submit its report and recommendations
 7  to the secretary of the senate and the chief clerk of the house of
 8  representatives on or before the first day of the 1999 regular session
 9  of the legislature.
10    (e)  The provisions of this section shall expire on July 1, 1999.
11    Sec. 2 3.  This act shall take effect and be in force from and after its
12  publication in the Kansas register.
