14 AN ACT relating to oil and gas; prescribing information to be included 15 with payments to interest owners from sales of oil and gas. 16 17 Be it enacted by the Legislature of the State of Kansas: 18 Section 1. Any person making a payment for proceeds attributable 19 to oil or gas production shall include, or shall be calculable from, the 20 following information with each payment made to a payee: When a pay- 21 ment is made for proceeds attributable to oil or gas production, the 22 payment shall be accompanied by, or calculable from, the following 23 information which shall be submitted the following information, or 24 the following information shall be calculable from the information 25 provided with the payment: 26 (a) The lease, property, or well name or any lease, property, or well 27 identification number used to identify the lease, or well; 28 (b) the month and year during which the sale occurred for which 29 payment is being made; 30 (c) the total volume of oil, attributable to such payment, measured in 31 barrels and the total volume of either wet or dry gas, attributable to such 32 payment, measured in thousand cubic feet; 33 (d) the price per barrel of oil or thousand cubic feet of gas sold; 34 (e) total amount of state severance and production taxes; 35 (f) payee's interest in the sale expressed as a decimal; 36 (g) payee's share of the sale before any deductions or adjustments; 37 (h) payee's share of the sale after deductions or adjustments; 38 (i) an address and telephone number where from which additional 39 information may be obtained and any questions answered. 40 Sec. 2. Nothing contained in this act shall be construed to amend or 41 otherwise affect any contractual obligations or rights which may otherwise 42 exist. 43 Sec. 3.       1  by certified mail, the payor shall provide to the payee in writing a specific
      2  listing of the amount and purpose of any other deductions or adjustments,
      3  including volumetric deductions, with explanation of such treatment.
      4  Such A written response shall be provided within 60 days of the receipt
      5  of such certified mail request.
      6    Sec. 4.  The district courts within this state shall have the jurisdiction
      7  to determine damages, interest, court costs, attorneys' fees or allowable
      8  litigation expenses incurred by a party in an action to enforce this act.
      9    Sec. 4.  The district courts within this state shall have the ju-
     10  risdiction to determine damages, interest, court costs, attorney
     11  fees or allowable litigation expenses incurred by a party in an ac-
     12  tion to enforce this act.
     13    Sec. 5 [4] 5.  This act shall take effect and be in force from and after
     14  January 1, 1998, and its publication in the statute book.
