10 AN ACT concerning the health care data governing board; amending 11 K.S.A. 1996 Supp. 65-6803 and repealing the existing section. 12 13 Be it enacted by the Legislature of the State of Kansas: 14 Section 1. K.S.A. 1996 Supp. 65-6803 is hereby amended to read as 15 follows: 65-6803. (a) There is hereby created a health care data governing 16 board. 17 (b) The board shall consist of seven nine members appointed as fol- 18 lows: One member shall be appointed by the Kansas medical society, 19 one member shall be appointed by the Kansas hospital association, one 20 member shall be appointed by the executive vice chancellor of the uni- 21 versity of Kansas school of medicine, one member who is a licensed 22 professional nurse appointed by the Kansas state nurses association, 23 one member representing health care insurers or other commercial pay- 24 ors shall be appointed by the governor, one member representing adult 25 care homes shall be appointed by the governor, one member representing 26 the institute associated with the university of Kansas department of health 27 services administration Kansas health institute, one member appointed by 28 the state board of regents and representing the health services research 29 community of the university of Kansas, Kansas state university of agri- 30 culture and applied science and Wichita state university, which shall 31 share the seat on a rotating basis as determined by the state board of 32 regents, and one member representing consumers of health care shall be 33 appointed by the governor. The secretary of health and environment, or 34 the designee of the secretary, shall be a nonvoting member who shall 35 serve as chairperson of the board. The secretary of social and rehabili- 36 tation services and the insurance commissioner, or their designees, shall 37 be nonvoting members of the board. Board members and task force mem- 38 bers shall not be paid compensation, subsistence allowances, mileage or 39 other expenses as otherwise may be authorized by law for attending meet- 40 ings, or subcommittee meetings, of the board. The members appointed 41 to the board shall serve for three-year terms, or until their successors are 42 appointed and qualified. 43 (c) The chairperson of the health care data governing board may ap- SB 130--Am.

 1  point a task force or task forces of interested citizens and providers of
 2  health care for the purpose of studying technical issues relating to the
 3  collection of health care data. At least one member of the health care
 4  data governing board shall be a member of any task force appointed under
 5  this subsection.
 6    (d)  The board shall meet at least quarterly and at such other times
 7  deemed necessary by the chairperson.
 8    (e)  The board shall develop policy regarding the collection of health
 9  care data and procedures for ensuring the confidentiality and security of
10  these data.
11    Sec. 2.  K.S.A. 1996 Supp. 65-6803 is hereby repealed.
12    Sec. 3.  This act shall take effect and be in force from and after its
13  publication in the Kansas register.
