9 AN ACT concerning agriculture; relating to meat and poultry inspection; 10 prescribing certain duties of the secretary of agriculture. 11 12 Be it enacted by the Legislature of the State of Kansas: 13 Section 1. (a) The secretary of agriculture shall cease all compliance 14 efforts to meet any requirements mandated by regulations of the food 15 safety and inspection service of the United States department of agricul- 16 ture concerning sanitation standard operating procedures and the hazard 17 analysis and critical control points, pursuant to 9 C.F.R. 304, 308, 310, 18 320, 327, 381, 416 and 417. The secretary, Kansas state university and 19 other state agencies shall cease providing information, education and 20 training to establishments required to be registered pursuant to article 6a 21 of chapter 65 of the Kansas Statutes Annotated and amendments thereto, 22 concerning the regulations of the food safety and inspection service of 23 the United States department of agriculture concerning sanitation stan- 24 dard operating procedures and the hazard analysis and critical control 25 points, pursuant to 9 C.F.R. 304, 308, 310, 320, 327, 381, 416 and 417. 26 (b) All rules and regulations of the department of agriculture in effect 27 on the effective date of this act, concerning meat and poultry inspection 28 and promulgated pursuant to article 6a of chapter 65 of the Kansas Stat- 29 utes Annotated and amendments thereto shall remain in force and effect. 30 The secretary shall not revise or amend such rules and regulations to 31 comply with the regulations of the food safety and inspection service of 32 the United States department of agriculture concerning the sanitation 33 standard operating procedures and the hazard analysis and critical control 34 points, pursuant to 9 C.F.R. 304, 308, 310, 320, 327, 381, 416 and 417. 35 (c) The secretary of agriculture shall study the impact and ramifica- 36 tions of the implementation of the regulations of the food safety and 37 inspection service of the United States department of agriculture con- 38 cerning the sanitation standard operating procedures and the hazard anal- 39 ysis and critical control points, pursuant to C.F.R. 304, 308, 310, 320, 40 327, 381, 416 and 417, on small processors in the state of Kansas and 41 shall report to the legislature of the state of Kansas on or before April 1, 42 1997, on such impact and ramifications. In such report, the secretary shall 43 make recommendations to the legislature to lessen such impact of such HB 2425

 1  implementation on such processors, provide alternatives which will avoid
 2  the significant cost and economic hardship associated with implementa-
 3  tion of the regulations and develop arguments and rationale to present to
 4  the United States department of agriculture that the current rules and
 5  regulations in effect in Kansas are adequate to protect the health and
 6  safety of the citizens of Kansas and the country and to justify continuation
 7  of the state meat and poultry inspection program.
 8    Sec. 2.  This act shall take effect and be in force from and after its
 9  publication in the Kansas register.
