13  AN ACT prohibiting certain abortions; amending K.S.A. 1996 Supp. 65-
14    6703 and repealing the existing section.

16  Be it enacted by the Legislature of the State of Kansas:
17    Section 1.  K.S.A. 1996 Supp. 65-6703 is hereby amended to read as
18  follows: 65-6703. (a) No person shall perform or induce an abortion when
19  the fetus is viable unless such person is a physician and has a documented
20  referral from another physician not financially associated with the phy-
21  sician performing or inducing the abortion and both physicians determine
22  that: (1) The abortion is necessary to preserve the life of the pregnant
23  woman; or (2) the fetus is affected by a severe or life-threatening defor-
24  mity or abnormality.
25    (b)  No person shall perform or induce an abortion by amnioinfusion
26  with a saline solution.
27    (c)  Nothing in this section shall be construed to create a right to an
28  abortion. Notwithstanding any provision of this section, a person shall
29  not perform an abortion that is prohibited by law.
30    (b) (d)  Violation of this section is a class A person misdemeanor.
31    Sec. 2.  K.S.A. 1996 Supp. 65-6703 is hereby repealed.
32    Sec. 3.  This act shall take effect and be in force from and after its
33  publication in the Kansas register.
