9 AN ACT authorizing boards of education of school districts to adopt pol- 10 icies providing for school bus transportation of certain persons to or 11 from class attendance at certain educational institutions; amending 12 K.S.A. 1996 Supp. 72-8316 and repealing the existing section. 13 14 Be it enacted by the Legislature of the State of Kansas: 15 New Section 1. (a) The board of education of any school district, 16 pursuant to a policy developed and adopted by the board, may provide 17 that whenever the school district furnishes school bus transportation for 18 pupils of the school district to or from attendance at class in an area 19 vocational school, area vocational-technical school, technical college, 20 community college, or four-year college or university, adults who are stu- 21 dents enrolled at any such educational institution may be furnished such 22 school bus transportation to or from attendance at class, on a space avail- 23 able basis, along with the pupils of the school district. Whenever any 24 school district shall furnish transportation for adult students pursuant to 25 a policy adopted under authority of this section, such transportation shall 26 be furnished subject to such terms and conditions as the board of edu- 27 cation of the school district shall impose. 28 (b) Fees for the furnishing of transportation for adult students pur- 29 suant to a policy adopted under authority of this section may be charged 30 such adult students to offset, totally or in part, any costs incurred by a 31 school district in the furnishing of such transportation, or such transpor- 32 tation may be furnished free of charge. Any revenues received by a board 33 of education as fees charged adult students for transportation furnished 34 under authority of this section shall be deposited in the transportation 35 fund of the district and may be expended whether the same have been 36 budgeted or not. 37 Section 2. K.S.A. 1996 Supp. 72-8316 is hereby amended to read as 38 follows: 72-8316. (a) Any board of education, pursuant to a policy devel- 39 oped and adopted by it, may provide for the use of district-owned or 40 leased school buses when such buses are not being used for regularly 41 required school purposes. 42 The policy may provide for: 43 (1) (A) Transporting parents and other adults to or from school-re- HB 2317

 1  lated functions or activities, (B) transporting pupils to or from functions
 2  or activities sponsored by organizations, the membership of which is prin-
 3  cipally composed of children of school age, and (C) transporting persons
 4  engaged in field trips in connection with their participation in an adult
 5  education program maintained by the transporting school district or by
 6  any other school district, within or outside the boundaries of the trans-
 7  porting school district; and
 8    (2)  contracting with (A) the governing body of any township, city or
 9  county for transportation of senior citizen groups or organizations, (B)
10  the governing authority of any nonpublic school for transportation of pu-
11  pils attending such nonpublic school to or from interschool or intraschool
12  functions or activities, (C) the board of trustees of any community college
13  for transportation of students attending enrolled in such community col-
14  lege to or from attendance at class at the community college or to or from
15  functions or activities of the community college, (D) a public recreation
16  commission established and operated under the laws of this state, for any
17  purposes related to the operation of the recreation commission and all
18  programs and services thereof, (E) the board of education of any other
19  school district for transportation, on a cooperative and shared-cost basis,
20  of pupils, school personnel, parents and other adults to or from school-
21  related functions or activities, or (F) a four-year college or university, area
22  vocational school or area vocational-technical school for transportation of
23  students to or from attendance at class at the four-year college or univer-
24  sity, area vocational school or area vocational-technical school or for
25  transportation of students, alumni and other members of the public to or
26  from functions or activities of the four-year college or university, area
27  vocational school or area vocational-technical school.
28    (b)  The costs related to the use of school buses under authority of
29  this section shall not be considered in determining the transportation
30  weighting of a school district under article 64 of chapter 72 of Kansas
31  Statutes Annotated.
32    (c)  Transportation fees may be charged by the board to offset, totally
33  or in part, the costs incurred for the use of school buses under authority
34  of this section.
35    (d)  Any revenues received by a board of education as transportation
36  fees or under any contract entered into pursuant to this section shall be
37  deposited in the transportation fund of the district and may be expended
38  whether the same have been budgeted or not.
39    (e)  The provisions of subsection (c) of K.S.A. 8-1556, and amend-
40  ments thereto, apply to the use of school buses under authority of this
41  section.
42    Sec. 3.  K.S.A. 1996 Supp. 72-8316 is hereby repealed.

 1    Sec. 4.  This act shall take effect and be in force from and after its
 2  publication in the statute book.
