AN ACT relating to adult care homes; establishing a rating system therefor. Be it enacted by the Legislature of the State of Kansas: Section 1. (a) The secretary of the department of health and envi- ronment shall develop by rules and regulations a rating system for adult care homes as defined in K.S.A. 39-923 and amendments thereto. The rating system shall have three categories: Level I. Those facilities that exceed the minimum standard established by the secre- tary for such facilities. Level II. Those facilities that meet but do not exceed the minimum standards estab- lished for such facilities. Level III. Those facilities that are found to be unsatisfactory and not meeting the minimum standards established for such facilities. (b) The secretary by rules and regulations shall establish the criteria to be met for each level of the rating system. (c) Rating scores for all facilities covered by the adult care home licensure act, K.S.A. 39-923 et seq. and amendments thereto shall be accessible to the public from the department of health and environment in a format which explains the three rating levels. (d) A notice shall be posted on a bulletin board readily accessible to the public in each adult care facility stating that facility's current rating and listing the three rating categories, what standard each level represents and what the criteria for each level is under the rules and regulations established by the secretary. (e) A facility may appeal its assigned rating in accordance with the Kansas administrative procedure act, K.S.A. 77-501 et seq. and amend- ments thereto and the act for judicial review and civil enforcement of agency actions, K.S.A. 77-601 et seq. and amendments thereto. Sec. 2. This act shall take effect and be in force from and after its publication in the statute book.
