AN ACT concerning the department on aging; relating to certain pro-
  grams and activities thereof and funding therefor; making appropria-
  tions for the fiscal year ending June 30, 1998.
  WHEREAS, The level of funding provided by the federal government
for programs of the Department on Aging has been reduced for the cur-
rent and prior fiscal years; and
  WHEREAS, This shortfall in federal funds, together with the corre-
sponding amount of state funds which were not appropriated for the
Department on Aging, have resulted in program reductions in Senior
Care Act programs and other programs financed in whole or in part under
the Federal Medicaid Program, the Federal Older Americans Act and
other federal programs; and
  WHEREAS, Appropriations should be made from the State General
Fund to replace this shortfall so that Senior Care Act programs, including
nutrition, transition assistance, in-home care, and other programs and
services in which there has been federal medicaid participation, can be
continued at the level of funding provided for the fiscal year that ended
July 1, 1996; and
  WHEREAS, Appropriations should be made from the State General
Fund to provide additional case management: Now, therefore,
Be it enacted by the Legislature of the State of Kansas:
  Section 1.  For the fiscal year ending June 30, 1998, appropriations
are hereby made, restrictions and limitations are hereby imposed and
transfers, fees, receipts, disbursements and acts incidental to the fore-
going are hereby directed or authorized as provided in section 2.
  Sec. 2.
DEPARTMENT ON AGING
  (a)  There is appropriated for the above agency from the state general
fund the following:
Administration ....................................................... $230,046
Program grants ..................................................... $2,306,332
Provided, That expenditures may be made from the program grants account for case
     man-
agement services which do not duplicate services provided under federal medicaid
     or other
federal programs.
  Sec. 3.  This act shall take effect and be in force from and after July
1, 1997, and its publication in the statute book.
