Chairperson Patton opened the hearing on HB2674. Natalie Scott provided an overview of the bill. She stood for questions. (Attachment 1)

Proponent

Shane Rolf explained this bill would make changes to K.S.A. 22-807 that would require a warrant to be issued in response to a failure to appear in court and resulting forfeiture of bail. In addition, it would provide additional defenses to enforcement of the forfeiture in certain circumstances. Mr. Rolf's written testimony explains a lot of additional information in support of the bill. Mr. Rolf stood for questions. (Attachment 2)

Ed Klumpp explained they understand an amendment is in process to have these provisions apply only to felony warrants. They prefer it be applied to only felony's not misdemeanors. They asked that whatever process is placed in the bill, the warrant be entered into the National Crime Information Center (NCIC). Also, the bill should include a time frame to do so. They suggested an alternative to the court order, something that would be in statute as a requirement that a sheriff enter a felony warrant into NCIC within 14 days and to notify the court if making that NCIC entry is not possible. Mr. Klumpp stood for questions. (Attachment 3)
