Substitute for SB 300 by Committee on Judiciary – Amending the Kansas racketeer influenced and corrupt organization act to add a person who has engaged in identity theft or identity fraud to the definition of "covered person" and add identity theft and identity fraud to the definition of "racketeering activity."

Vice Chairman Bradley Ralph stated the meeting would stand at ease for a few minutes until Chairman Patton arrived.

Meeting called to order at 3:35 pm by Chairperson Patton.

Chairperson asked the membership for any discussion on minutes for February 1st, 3rd, 7th, 8th, 9th, 10th, and 15th. Representative Hoheisel moved to approved the minutes. Representative Humphries seconded. Motion carried.

Chairperson Patton opened the hearing on SB300. Natalie Scott provided an overview of the bill. She stood for questions. (Attachment 1)

Proponents

Greg Smith and the Johnson County Sheriff’s Office supports SB300. Identity theft is one of the fastest growing crimes in the United States and Kansas is no exception. According to our research, Kansas ranks in the top five for identity theft victims per 100,000 in population - 187 victims per 100,000 people. There are organized groups and individuals that engage in credit card and identity theft. The techniques used vary from real-world to online tactics. All have the same result, the stealing of a person’s identity that is then used or sold causing absolute chaos in the victim’s life. This bill provides another tool for Law Enforcement and prosecutors to combat this crime. Mr. Smith stood for questions. (Attachment 2)
