Proposing a constitutional amendment that provides for legislative authority to revoke or suspend rules and regulations adopted by executive branch agencies and officials.

Chairperson Warren opened the hearing on SCR1618.

Jenna Moyer, Assistant Revisor, provided an overview of SCR1618 and stood for questions. (Attachment 1)

Attorney General Derek Schmidt provided a brief history of the constitutional structure for legislative authority and the delegation of rule making authority to agencies and testified in support of SCR1618 to amend the constitution placing legislative authority back to the legislature. (Attachment 2) Attorney General Schmidt responded to questions from Committee members.

Eric Stafford testified in support of SCR1618, stating the bill provides another level of checks and balances to ensure that agencies are not getting out of their line with the rules and regulations authority the legislature is granting them. (Attachment 3)

Elizabeth Patton testified in support of SCR1618, stating elected lawmakers should retain their proper role in developing and finalizing laws that include clear and unambiguous guidance and is of the opinion that the legislature has gradually given away broad authority to regulatory agencies resulting in an imbalance of power. (Attachment 4)

Randy Stookey tesified in support of SCR1618, stating agri-business operates in a highly regulated industry at the front end and back end with agriculture producers. If those regulations are thought to be unreasonable, too costly, or are beyond the scope of legislative intent then authority should remain in the legislative body which is most directly representative and answerable to the people. (Attachment 5)
