Chairperson Warren opened the hearing on SB457.

Jason Thompson, Senior Assistant Revisor, provided an overview of SB457 and stood for questions. (Attachment 10)

Special Deputy Sheriff Greg Smith testified in support of SB457, stating the bill would help address the long, protracted extradition process that involves: 1) the agency that has charges against the fugitive, 2) the local county or district attorney, 3) the Kansas Attorney General's Office, 4) the Kansas Governor's Office, 5) the governor of the asylum state where the fugitive fled to, 6) the attorney general of the asylum state, 7) the local prosecutor where the fugitive was apprehended, 8) the jurisdiction that has the Kansas fugitive in custody, and 9) the court that has jurisdiction.

Sheriff Smith further stated there are three things that control extradition: the federal constitution, federal statutes, and the Uniform Criminal Extradition Act (UCEA). The UCEA is somewhat like an interstate compact in which 48 states participate. Missouri does not. Last year, Johnson County had 246 fugitive cases and 193 of the cases were in Missouri. All refused extradition. (Attachment 11) Sheriff Smith responded to questions from Committee members.
