Minutes for HB2112 - Committee on Commerce

Short Title

Permitting online advertisement and sales of abandoned property by self-storage rental unit operators; providing for the designation by occupants of an alternate contact and limiting claims for loss or damage of stored property to the property value limit provided in the rental agreement.

Chairman Olson open the hearing on HB2112 and called upon Charles  Reimer, Revisor of Statutes, for an overview of the bill.

Chairman Olson called upon Whitney Damron for primary proponent testimony on the bill. Mr. Damron outlined four changes the bill would enact:

1.) Make damage loss limitations in contract enforceable in law.

2.) Require third party notification of a potential default in contractual obligations.

3.) Allow auctions to be conducted in-person and/or online.

4.) Remove requirement that the official notice of the time, place and terms of contract would no longer require publication in a paper based newspaper media.

Committee questions and comments ensued.

Chairman Olson called upon  Emily Bradbury  for opponent testimony on the bill. Ms Bradbury cautioned the committee that the bill would decrease transparency and be conducive to more litigation. Ms. Bradbury reminded the committee that the original requirement newspaper publication was the result of courts giving up jurisdiction years ago.
