Staff explained the bill and answered questions.  (Attachment 1)

The Chairman recognized Adam Lusker.  (Attachment 2) Mr. Lusker said this bill changes the definition for all terrain vehicles and recreational off-highway vehicles in Kansas statutes.  He said this change will align the definition in Kansas statutes with the new industry standards which are transforming to meet consumer demands.

J.R. Burke was the next proponent. (Attachment 3)  He said SB67 updates off-road vehicle definitions in order to keep up with substantial innovation in this area of outdoor recreation. He said many states are in the midst of updating their off-road vehicle definitions. Mr. Burke said what is done here today will work to ensure that Kansas and its small business community supporting the outdoor economy, are able to continue their growth and on a level playing field with their neighboring states.

Chairman Proehl recognized Jay Hatfield. (Attachment 4)   According to Mr. Hatfield this legislation will help his business by tweaking definitions in Kansas statutes for all-terrain vehicles and recreational off-highway vehicles.  He said this change in statute will bring Kansas law closer to the laws of bordering states that he might otherwise lose customers to.

The Chairman drew the Committee's attention to written testimony in support of SB67 by John Donley, Kansas Farm Bureau.  (Attachment 5)

The Chairman then drew the Committee's attention to written neutral testimony submitted by Wendi Stark with the Kansas League of Municipalities. (Attachment 6)

There being no other proponents, opponents or neutrals, the Chairman closed the hearing on SB67 and opened the hearing on SB95.
