Minutes for HB2688 - Committee on Agriculture and Natural Resources Budget

Short Title

Allowing the state board of veterinary examiners to make assessments to recoup certain administrative costs and to remit all moneys collected by the board from fees, charges, assessments and penalties to the veterinary examiners fee fund.

The Chairperson opened the hearing on HB2688.

David Wiese, Office of the Revisor of Statutes, explained the legislation. The legislation would add a new section to the Kansas veterinary practice act. It would allow the costs of investigation and hearings be collected if the decision for licensure was adverse to the applicant. If the process was not adverse to the applicant, the regulatory board's fee fund would pay the costs. The bill also would allow the board to keep 10% of licensing fees rather than transferring to the State General Fund. (Attachment #1)

Dr. Jody Johnson, Executive Director, Kansas Board of Veterinary Examiners testified in favor of the legislation. Dr. Johnson stated the legislation would allow the board to recoup expenses for investigating applicants who were not granted a license. She stated this practice is consistent with other regulatory boards. The noted the last major case was in 2017 and the amount assessed for court costs was $2800.00. The legislation also removes all reference to the Department of Agriculture when the board had merged with the department for a two year period.  (Attachment #2)

There were no additional conferees.

The hearing on HB2688 was closed.

A Committee member asked for discussion regarding the Department of Commerce budget the Committee had amended and passed out of the Committee in an earlier meeting. The Chairperson reported the House Appropriations Committee considered the budget and changes were made.

With no further business, the meeting was adjourned at 1:55 pm.
