Chair Kelly opened the hearing on HB 2197, recognized David Wiese, Assistant Revisor of Statutes, who briefed the committee on HB 2197(Attachment 1) A question and answer period followed.

Informational - Chair Kelly recognized Alan D. Conroy, Executive Director, KPERS, who provided detailed information regarding HB 2197(Attachment 2) (Attachment 3) A question and answer period followed.

Proponents - Chair Kelly recognized Larry Campbell, Director of the Budget, State of Kansas Division of the Budget, who provided information supporting HB 2197. (Attachment 4)  A question and answer period followed.

Neutral - Chair Kelly recognized Mark Tallman, Executive Director, Kansas Association of School Boards, who indicated that KASB is neutral on the issue, basically because the the issue has not been presented to members, and that the issue at hand is a policy choice for legislators. (Attachment 5) No questions presented from the committee.

Opponent - Chair Kelly recognized the following individuals who provided information in opposition to HB 2197: Jarold W. Boettcher, Former KPERS Board of Trustees,1991-2008, (Attachment 6); and Representative Steven Johnson, 108th District, Assaria, Kansas House of Representatives, (Attachment 7) (Attachment 8) No questions presented from the committee.

Chair Kelly closed the hearing on HB 2197.

Chair Kelly informed the committee that he would like to work this bill and present it to the Kansas House of Representative's Committee of the Whole for further consideration.

Chair Kelly recognized Representative John Barker who made some general remarks and then presented a motion.

Representative John Barker made a motion to suspend the rules and work HB 2197 immediately, seconded by Representative Boyd Orr and passed on a voice vote.
