Amending the Kansas money transmitter act.

David Wiese, staff revisor, reviewed the bill.

Motion by Representative Finney, second by Representative Dietrich, to recommend SB284 favorably for passage.

A proposed balloon amendment to SB284 was distributed by David Wiese and reviewed by Representative Jennings. (Attachment 4)  The amendment would limit the character of acts which could be subject to informal agreements to administrative failures and would exclude criminal violations. The amendment would also make a technical change replacing a semi-colon with a period in line 28.

Representative Jennings moved, Representative Finney seconded, to adopt the proposed balloon amendment to SB284.  Motion carried.

A second proposed balloon amendment to SB284 was distributed by David Wiese and reviewed by Representative Trimmer. (Attachment 5)  The amendment would strike the text on lines 28-36 which would make the informal agreements not subject to the open records act. Striking the language would ensure that informal agreements would be available to the public.

Michelle W. Bowman addressed questions from the Committee.

Representative Trimmer moved, Representative Finney seconded, to adopt the second proposed balloon amendment to SB284.  Division was noted on voice vote and Chairperson Kelly called for a show of hands.  The motion failed by a vote of six (6) in favor and ten (10) against.   Representatives Tim Hodge, Ed Trimmer and Virgil Weigel asked that their votes be recorded as "yes."

Representative Jennings moved, Representative Vickrey seconded, to recommend SB284, as amended, favorably for passage.  Motion carried.
