Staff briefed the Committee on the bill.  Staff said there was a proposed amendment if the bill goes to Final Action in Committee.

Chairman Proehl recognized Representative Ruiz as the first proponent.(Attachment 1)  Representative Ruiz asked the Committee to consider this bill concerning the operation of a motor vehicle, eliminating the use of a hand-held wireless communication devise while the vehicle is in motion.  He said the law/policy makers bear the responsibility for the safe practices for all citizens and those who pass through our state.

The next proponent was Bob Eckhardt who said he supported the bill if a change could be made to rectify an oversight.  He said it was important the restriction of cell phones and other devices in moving vehicles not inadvertently impair other types of wireless communication such as amateur radio communication.(Attachment 2)

Julie Breitenstein, resident of Wichita, KS spoke on behalf of her son who was injured in a texting while driving accident.  She feels this bill could save many lives.(Attachment 3)

There was written testimony provided in support of this bill by the Kansas Department of Transportation.(Attachment 4)

There were no opponents.

After all questions were answered the Chairman closed the hearing on HB2010 and opened the hearing on HB2016.
