Minutes for HB2682 - Committee on Transportation

Short Title

Authorizing the director of vehicles to adopt rules and regulations for participation in the federal motor carriers safety administration's drug and alcohol clearinghouse and disqualifying a person's commercial vehicle driving privileges when such person has violated or is noncompliance with the requirements of the clearinghouse.

Chairperson Petersen called the meeting to order at 8:33 a.m. and opened the hearing on HB2682.

Adam Siebers, Assistant Revisor, Office of the Revisor of Statutes, briefed the Committee on the bill (Attachment 1).  He explained that the bill authorizes the Director of Vehicles, Kansas Department of Revenue, to adopt rules and regulations for participation in the Federal Motor Carrier Safety Administration's Drug and Alcohol Clearinghouse (DACH).  The DACH maintains information regarding commercial driver license (CDL) holders' status in relation to the U.S. Department of Transportation's controlled-substances and alcohol testing programs.  He said that prior to the Director issuing or renewing a CDL, the Director must query the DACH to determine whether or not the driver is in violation or is noncompliant.  The Director must disqualify a driver's CDL within 60 days unless the CDL driver is determined to be in compliance.

Joel Skelley, Director of Policy, Kansas Department of Transportation (KDOT), testified in support of the bill (Attachment 2).  He stated that without the bill Kansas would become noncompliant with federal law and lose $19 million the first year and about $40 million in subsequent years. He explained that these federal funds provide the most flexibility for addressing KDOT services.  Responding to a question, he replied that KDOT's involvement in interstate traffic allows access to certain federal grant programs.

Kent Selk, Driver Services Manager, Division of Vehicles, Kansas Department of Revenue, testified as a proponent for the bill (Attachment 3).  He commented that beginning November 18, 2024, states receiving Motor Carrier Safety Assistance Program grant funds must comply with certain federal regulations, among which are regulations regarding CDL drug/alcohol violations.  This bill will assure that Kansas is in compliance with these regulations.
