Minutes for SB491 - Committee on Judiciary

Short Title

Standardizing criminal history record check fingerprinting language and defining who may be fingerprinted for a criminal history record check.

Chairwoman Warren opened the hearing on SB491.

Jason Thompson provided an overview of the bill and stood for questions. (Attachment 1) 

Robert Jacobs, Associate Director, Kansas Bureau of Investigation, provided testimony in support of SB491, which will combine and standardize language that must be cited in state statute to allow a non-criminal justice agency to receive national criminal history record information. (Attachment 2)

Chairwoman Warren would to like to see a list of entities that use fingerprint and criminal history record information. Natalie Nelson, Kansas Legislative Research Department, provided the information subsequent to the meeting on February 19th. (Attachment 3)

Joseph House, Associate Director, Kansas Board of Emergency Medical Services, testifies in support of the bill.  They are asking for consideration of an amendment to correct an oversight.  Records of adjudication are very necessary to our licensing process. (Attachment 4)

Written-only testimony in support of SB491 was submitted by Jennifer Caswell, Kansas State Chapter of the American Physical Therapy Association.  (Attachment 5)

Alexandra Blasi, Kansas Board of Pharmacy provided neutral testimony and supportive to the KBI recommendation. The Board requests the Committee consider the amendment prior to passage out of Committee, to include the term applicant, registrant or licensee be fingerprinted.  (Attachment 6)

Eric Turek, Director of Government and Public Affairs, Kansas Insurance Department provided neutral and supportive testimony to SB491. Mr Turek state there are three items that need to be addressed and the provisions should be restored to existing statutes.  (Attachment 7)
