Minutes for SB153 - Committee on Ways and Means

Short Title

Making and concerning supplemental appropriations for fiscal years 2023 and 2024 for various state agencies.

Chairperson Billinger called for final action on SB 153 and SB 155.

Staff distributed the shorthand list that reflects all adjustments made by the Committee to this point.  (Attachment 1)

Senator Claeys moved, Senator Masterson seconded, to return to the Governor's recommendation for the Department of Revenue FTEs regarding funded and unfunded positions in FY 2023 and FY 2024 and review at Omnibus. Motion carried.

Senator Claeys moved, Senator Fagg seconded, to delete and review all salary adjustments, including the Judicial Branch, at Omnibus. Motion carried.

Chairperson Billinger announced that the Committee will work through Attachment 1 item by item and then had staff distribute a document with recommended adjustments that the Committee will consider.  (Attachment 2)

FY 2023: No changes.

FY 2024:

Office of the Governor:

Senator Claeys moved, Senator Masterson seconded, to delete the Office of the Governor items on attachment 2 and review at conference. Motion carried.

Department of Revenue:

Senator Claeys moved, Senator Masterson seconded, for item 1 on attachment 1 to return the funds to the State Highway Fund and and review at conference. Motion carried.

Department of Commerce:

Senator Masterson moved, Senator McGinn seconded, to review all Commerce deletions at conference. Motion carried.

Kansas Department of Health and Environment--Division of Health:

Senator Claeys moved, Senator Masterson seconded, to consider at conference items 2, 3, 5 and 6 on attachment 1. Discussion ensued.

Senator Claeys amended his motion to delete item 2, add item 3, delete item 5, and delete $800,000 SGF for item 6 and review all at conference. Senator Masterson seconded. Motion carried.

Staff distributed a document concerning air ambulance services.  (Attachment 3)

Senator Claeys moved, Senator Masterson seconded, to add the air ambulance language and funding and to review at conference. Motion carried.

Senator Claeys moved, Senator Masterson seconded, to delete $671.4 million, including the addition of $71.5 million SGF, to remove funding for Medicaid Expansion for FY 2024. Motion carried. Senators McGinn, Pettey and Pittman are recorded as voting no.

Kansas Department on Aging and Disability Services:

Senator Claeys moved, Senator Masterson seconded, to delete item 1 on attachment 1 and review at conference. Motion carried.

Senator Claeys moved, Senator Masterson seconded, to delete items 9, 11 and 14 of attachment 1 and review at conference. Motion carried.

Department for Children and Families:

Senator Claeys moved, Senator Masterson seconded, to delete and review at conference item 3 of attachment 1; to delete and review at conference, while also adding the same amount from TANF, for item 5; and the addition and review at conference of language allowing the Children's Initiative Fund account in the Kansas Children's Cabinet to reappropriate for FY 2023 and FY 2024. Motion carried.

Board of Regents:

Senator Pittman moved, Senator Pettey seconded, to strike item number 3 of attachment 1. Motion failed.

Department of Education:

Senator Claeys moved, Senator Masterson seconded, to delete and review at conference language extending the sunset on the High Density at Risk Weighting. Motion carried. Senators McGinn, Pettey and Pittman are recorded as voting no.

Kansas Bureau of Investigation:

Senator Claeys moved, Senator Masterson seconded, to delete $3.5 million from item 1 of attachment 1, to change the $910,000 for the HVAC system to $900,000 and to review at conference. Motion carried.

FY 2025: No changes

Additional Items:

Senator Claeys moved, Senator Masterson seconded, to add the language for the Board of Indigents Defense Services reporting requirements from attachment 2.

Senator Pettey made a substitute motion to also add language concerning reporting requirements for the Attorney General's office. Senator Pittman seconded. Motion failed.

Back on the original motion, motion carried.

Senator McGinn distributed a proviso concerning the Board of Barbering and discussed the proposed changes.  (Attachment 4)

Senator McGinn moved, Senator Claeys seconded, adoption of the proviso. Motion carried.

Senator Claeys moved, Senator Fagg seconded, to insert the contents of SB 153 into SB 155, that all adopted Committee amendments be included, that SB 155 be recommended as a substitute, that staff be authorized to make any technical amendments and that Substitute for SB 155 be recommended favorably for passage. Motion carried on a roll call vote.

Staff also distributed a document displaying the current list of items for Omnibus consideration.  (Attachment 5)
