Short Title

Enacting the Kansas film and digital media industry production development act, providing a tax credit, sales tax exemption and loans and grants to incentivize film, video and digital media production in Kansas and establishing a program to be administered by the secretary of commerce for the purpose of developing such production in Kansas.

Chairperson Smith opened the hearing for HB2182.

Adam Siebers, Assistant Revisor, presented an overview for HB2182 creating the Kansas Film and Digital Media Production Development Act.  The purpose of the act is to incentivize film, video, or digital media productions in Kansas and to facilitate the development and growth of a film, video, or digital media production industry and associated businesses supporting the industry in Kansas.  The Act is administered by the Secretary of Commerce with the assistance of the Kansas Creative Arts Industries Commission.  Projects must be approved by the Secretary of Commerce and the Act would commence July 1, 2023 and discontinue in 2033.  (Attachment 1)  Mr. Siebers stood for questions from Committee members.

Kathleen Smith, Kansas Department of Revenue, stated it is estimated that HB2182 would decrease the State General Fund revenues by $12.0 million in FY2024 and each future fiscal year after that through year 3033.  The Department of Revenue is assuming that the full amount of the $10.0 million and allowable credits would be awarded by the Department of Commerce each year and in addition authorizes two $1.0 million transfers each year from the State General Fund for two separate grant programs.  There is also a project exemption certification or sales tax exemption that is in place for Film Production but there is no information as to how much that would cost at this time.  Ms. Smith stood for questions from Committee members.
