Minutes for HB2068 - Committee on Corrections and Juvenile Justice

Short Title

Modifying how certain prior convictions are counted for the special sentencing rule related to possession of a controlled substance and providing concurrent or consecutive sentencing for persons convicted of new crimes while on release for a felony.

Chairperson Owens opened the hearing on HB2068.  Natalie Scott reviewed the bill.  (Attachment 1)  Ms. Scott responded to questions from committee members.

Scott Schultz, Executive Director of the Kansas Sentencing Commission testified in support of the bill.  This bill amends special sentencing rules commonly referred to as Special Rules #10, #12, and #26.  This same bill, (2022)HB2081, was passed out of the House last year and died in the Senate Judiciary.  (Attachment 2)  Mr. Schultz responded to questions from committee members.

Jennifer Roth testified on behalf of the State Board of Indigent Defense Services in support of this bill.  She said this bill clears up conflicting language between statutes and this bill distinguishes between people who commit a new offense while on bond and those who commit a new offense while on supervision.  (Attachment 3)  Ms. Roth responded to questions from committee members.
