Minutes for HB2262 - Committee on Health and Human Services

Short Title

Eliminating the requirement to provide a permit to cremate in certain circumstances and authorizing electronic permits to cremate.

Minutes Content for Tue, Feb 16, 2021

Scott Abbott, Revisor of Statute, provided an overview of HB2262.

Pam Scott, Executive Director, Kansas Funeral Director Association, provided testimony is support of HB2262. Current Kansas statute requires a coroner's permit to cremate must be furnished in order for a body to be cremated in Kansas regardless of where the death or cause of death occurred. This proposed bill would amend the statute to provide that if death and cause of death occur outside of Kansas, and the law of the state where the death occurred does not require a permit, a permit will not be required to cremate in Kansas. If the death occurred in Kansas the coroner's permit would still be required. This legislation particularly addresses the issue in the metro Kansas City area but could also apply to areas bordered by other states.

HB2262 also adds language to clarify statute that an electronically signed copies are acceptable along with facsimile copies.

HB2262 would repeal statute that requires funeral directors file monthly reports of dead bodies prepared for burial with the Office of Vital Statistics. The state has gone to an electronic death registration system. The reports are no longer necessary since the state obtains the information immediately when the death record is filed electronically (Attachment 2).

Ms. Scott responded to questions from the committee.

The hearing was closed.

Representative Eplee motioned and Representative Parker seconded to advance HB2262 favorably for passage. Motion carried.
