Minutes for SB308 - Committee on Agriculture and Natural Resources

Short Title

Allowing the on-farm retail sale of raw, unpasteurized milk so long as certain labeling and advertising requirements are met.

Chairperson Kerschen called for final action on SB308.

Tamera Lawrence with Revisor of Statutes Office explained the bill. It would amend the existing law concerning milk, cream dairy products, and on farm retail sale of milk to make on farm retail sale of milk and milk products lawful if the label or advertisement for the products contains language specified in the bill.

Chairperson Kerschen requested an amendment by the Kansas Department of Agriculture be handed out to the committee.  Tamera Lawrence with the Revisor of Statutues Office explained the amendment.(Attachment 1)

There was some discussion about terminology in the amendment.  Senator Francisco wondered why it left ungraded milk in the bill and not unpasteurized. She also felt that the term similar on the government website was vague.

Senator Berger opposed the amendment and offered a substitute balloon amendment.(Attachment 2)

There was discussion on the amendment.  Senator Francisco expressed a concern about labels on containers since many customers bring in their own containers. Would those private containers have to be labeled? The general consensus was that if people brought in their own containers there would not be a label.

Senator Berger moved and Senator McGinn seconded the committee adopt the amendment.  Motion carried.

Senator Francisco offered a conceptual amendment on page 5, line 29 to change ungraded to unpasteurized.  Senator Francisco moved and Senator Taylor seconded to adopt the conceptual amendment.  Motion carried.

Senator Francisco then proposed a balloon amendment which changed the word "cows" to "mammals" on page 3, line 25.(Attachment 3) After some discussion, Senator Francisco moved and Senator Ware seconded that the amendment be passed favorably by the committee.  Motion carried.

Senator Berger moved and Senator Estes seconded that SB308 as amended by passed favorably by the committee.  Motion carried.

With no other business before the committee, Chairperson Kerschen adjourned the meeting at 9:00.
